Respon terhadap tuntutan regulasi ojek :: Studi kasus di Kota Ternate

Kota Ternate banyak menerima pengungsi muslim, penduduk non-muslim memilih keluar dari Kota Ternate, karena telah dikuasai kelompok muslim. Dampaknya adalah terjadi kepadatan penduduk, dan kelangkaan alat transportasi umum, khususnya mobil angkutan penumpang, karena banyak pengusaha mobil angkutan penumpang mengungsikan mobilnya ke daerah lain. September 1999, ojek yang beroperasi sebanyak 25 anggota, interval 4 bulan yaitu Januari 2000 mencapai 750 anggota. Para pengurus ojek itu membentuk Badan Pekerja dengan agenda setting, menuntut kepada Pemerintah Daerah (legislatif-eksekutif) agar diregulasi. Respond Pemerintah Daerah terhadap tuntutan itu melalui Surat Keputusan Walikota no. 03 tanun 2001, yang bersifat alternatif. Eksistensi Surat Keputusan itu beralasan antara lain : pelayanan transportasi masyarakat, di samping memberi peluang kerja bagi para pengungsi. Di level implementasi Surat Keputusan itu gagal total, sementara ojek semakin bertambah, lalu limas pun semakin semraut, sehingga Pengurus Organda dan Ikatan Solidaritas Sopir Angkutan Penumpang (ISSAP) Kota Ternate menuntut agar SK itu dicabut, namun respond Walikota mengeluarkan SK no. 07 tanun 2003. Untuk mengetahui kondisi itu, dalam penelitian ini merumuskan masalah " Bagaimanakah dinamika pengambilan keputusan yang diternpuh eksekutif kgislatif dalam merespon frnomena ojek di Kota Ternate". Tujuannya untuk mengetahui bentuk respond eksekutif-legislatif tentang tuntutan regulasi ojek sebagai angkutan penumpang di jalan raga. Pendekatan yang digunakan dalam metodologi yaitu pendekatan kualitatif Qualitative Aproach), dengan menggunakan analisis deskriptif, terhadap data primer, sekunder dan hash! observasi. Setelah dianalisis, dapat disimpulkan bahwa ternyata dalam pengambilan keputusan Pemerintah Daerah dalam meregulasi ojek di Kota Ternate sangat bernuansa kepentingan, terjadi intrik politik dari kalangan perjabat Pemerintah Daerah untuk memenuhi kepentingan mereka masing-masing.
The appearance of ojeks in Ternate City was highly connected to the social conflict that attacked violently North Moluccas in September 1999. Ternate City, the Province Capital received many Moslem refugees, while the non-Moslem people preffered to the outside of Ternate City, since the Moslem controlled the City. The implication of that condition was the population density, besides it also the scarcity of public transportation cars, particularly passenger ones. Many of passanger transportation entrepreneurs preffered to take refuge in other places for their cars. At first, in September 1999, there were only 25 ojek members, but 4 months afterward, in January 2000, it hed been 750 ojek members. The increase was more apparent one year thereafter, in 2001, it achieved 2600 ojek members, while their operations have no licenses (illegal). Realizing their illegality, the ojek board formed working committee with setting agenda, demanded from the Regional Government (legislativeexeculive) that the ojeks be regulated as the public transportation cars. The government response to the demand, via the 03/2001 Mayor Decree, was an alternative, because it couldn’t allow in form of Regional Regulation. The Decree existence has reasons, among others: besides for the people transportations service, it also provided awork opportunity for the refugees. At the implementation level, the Decree experienced a total failure, all the stipulations of it was not realized. The more ojeks increased, the more disorganized traffic was, so that the Organda (Regional Transportation Organization) and ISSAP (Passenger Transportation Driver Solidarity Association) Boards of Ternate City demanded that the Decree to be annulled. The mayor responded by issuing thae 7/2003 Decree as a revision of the previous Decree. To know the condition, in this study we formulated the matter “ How the process of decision-making taken up by legislative and executive in responding the ojek problem in Ternate City isâ€. The purpose is to know the response from of legisletive-executive to the ojek regulation demand as passenger transportation in the main roads. The approach used in methodology was the qualitative one, by using descriptive analyses to the primary, secondary data and obsevation results. After that, it could be concluded that the interst nuances of regional afficials in decision-making process for regulating Ternate City ojeks were very visible.
