INTISARI

Pemerintah berupaya untuk meningkatkan nilai investasi negara dan direalisasikan melalui pengesahan UU Ciptaker untuk menyederhanakan birokrasi perizinan. Perubahan tersebut berdampak pada sistem perizinan yang berbasis risiko dan pergeseran peran DPMPTSP Kabupaten Sleman dalam kegiatan pengawasan perizinan berusaha. Tujuan penelitian ini untuk mengetahui perbedaan peran penyelenggaraan pengawasan saat sebelum dan setelah UU Ciptaker. Penelitian ini juga untuk mengetahui pelaksanaan pengawasan perizinan berusaha berbasis risiko oleh DPMPTSP Kabupaten Sleman dalam mengakomodasi kepentingan masyarakat. 

Penelitian ini merupakan jenis penelitian normatif-empiris yang bersifat deskriptif. Sumber data penelitian ini menggunakan sumber data primer dan sekunder dengan studi kepustakaan dan studi lapangan yang diperoleh dari hasil wawancara dengan responden dan narasumber. Penelitian ini dianalisis dengan metode kualitatif dengan menggunakan pendekatan peraturan perundang-undangan (the statute approach) dan sosiologi hukum (sociological sociological jurisprudence) untuk menganalisis lebih lanjut penerapan hukum dalam peranan lembaga atau institusi hukum terhadap proses penegakan hukum.

Penelitian ini mengungkapkan bahwa perubahan sistem perizinan pasca UU Ciptaker secara praktik lebih sederhana, cepat, dan memudahkan daripada sebelumnya. OSS-RBA memberikan kemudahan pada peran pengawasan DPMPTSP Kabupaten Sleman. Akan tetapi, kemudahan tersebut justru menimbulkan celah hukum, seperti lengahnya mitigasi risiko dan sistem pengawasan yang cenderung represif. Ditinjau dari Hukum Administrasi Negara, kemudahan birokrasi perizinan belum sepenuhnya efektif pada praktik pengawasan di Kabupaten Sleman karena belum sepenuhnya memberikan perlindungan kepada masyarakat. 

ABSTRACT

The government has undertaken measures to enhance the nation;s investment value, one of which is the enactment of the Omnibus Law on Job Creation, intended to streamline bureaucratic procedures in business licensing. The regulatory reform has resulted in a transformation of the licensing system toward a risk-based approach and has redefined the role of the investment and One-Stop Integrated Services Office of Sleman Regency (DPMPTSP of Sleman Regency) in the supervision of business licensing activities. This study also aims to examine the implementation of risk-based business licensing supervision by the DPMPTSP of Sleman Regency in accommodating the interest of the public.

This research adopts a normative-empirical legal approach with a descriptive analytical framework. The data sources consist of both primary and secondary materials, obtained through library research and field studies, including interviews with respondents and resource persons. The data are analyzed qualitatively using the statute approach and the sociological jurisprudence approach, in order to assess the application of legal norms within institutional practices and the broader process of law enforcement.

The findings of this study indicate that, practically, the licensing system post-enactment of the Omnibus Law is more simpler, faster, and more accessible compared to the previous regime. The implementation of the OSS-RBA has facilitated the supervisory functions of the DPMPTSP of Sleman Regency. However, this simplification has also introduced certain legal vulnerabilities, such as reduced effectiveness in risk mitigation and a supervisory mechanism that tends to be repressive in nature. From the perspective of Administrative Law, the simplification of the licensing bureaucracy has not yet demonstrated full effectiveness in practice, particularly in terms of supervision in Sleman Regency, as it has not entirely fulfilled its role in safeguarding public interest.
