KONSTRUKSI KONSENSUS DALAM REVISI UNDANG-UNDANG LALU LINTAS ANGKUTAN JALAN (LLAJ) NO. 22 TAHUN 2009: Analisis Kritik Rasionalitas Komunikatif Habermas di Komisi V DPR RI

Penelitian ini mengkaji konstruksi konsensus dalam revisi Undang-Undang Lalu Lintas Angkutan Jalan (LLAJ) No. 22 Tahun 2009 dengan menggunakan pendekatan rasionalitas komunikatif Habermas dan kritiknya. Fokus utama penelitian adalah melihat proses deliberatif di Komisi V DPR RI dapat menghasilkan konsensus yang mencerminkan kepentingan publik secara inklusif dan adil dalam konteks kebijakan transportasi. Melalui metode kualitatif deskriptif dengan pendekatan studi kasus, data dikumpulkan melalui wawancara, observasi, studi pustaka, dan dokumen resmi. Hasil penelitian menegaskan bahwa keberhasilan membangun konsensus bergantung pada komunikasi yang efektif, inklusif, dan bebas dominasi di antara para aktor yang terlibat. Prinsip-prinsip Habermas seperti kesetaraan, kejujuran, dan penghindaran dominasi menjadi kunci dalam menciptakan dialog yang produktif. Penelitian ini mengungkap bahwa dinamika tarik ulur kepentingan di dalam proses revisi memerlukan negosiasi berbasis rasionalitas untuk menciptakan kesepakatan yang berkelanjutan. Studi ini juga mengeksplorasi faktor-faktor yang mempengaruhi keberhasilan atau kegagalan pencapaian konsensus, termasuk potensi distorsi komunikasi akibat intervensi politik dan kepentingan kelompok tertentu. Selain itu, realitas disensus, berupa perbedaan pandangan dan konflik kepentingan antar aktor, memainkan peran penting dalam memperkaya proses deliberatif. Dengan demikian, studi ini berkontribusi dalam memperkuat pemahaman tentang praktik demokrasi deliberatif dan relevansinya untuk kebijakan yang lebih partisipatif dan berbasis pada prinsip deliberatif dalam sistem legislasi di Indonesia.

This research examines the construction of consensus in the revision of the Road Traffic and Transportation Law (LLAJ) No. 22/2009 using Habermas' communicative rationality and critical approach. The main focus of the research is to see how the deliberative process in Commission V of the House of Representatives can produce consensus that reflects the public interest in an inclusive and fair manner in the context of transportation policy. Through a descriptive qualitative method with a case study approach, data was collected through interviews, observations, literature studies, and official documents. The results confirm that the success of consensus building depends on effective, inclusive, and domination-free communication among the actors involved. Habermas' principles such as equality, honesty, and avoidance of domination are key in creating productive dialog. This study reveals that the dynamics of competing interests in the revision process require rationality-based negotiations to create a sustainable agreement. This study also explores the factors that influence the success or failure of consensus achievement, including the potential for communication distortion due to political intervention and the interests of certain groups. In addition, the reality of consensus, in the form of differences in views and conflicts of interest between actors, plays an important role in enriching the deliberative process. As such, this study contributes to strengthening the understanding of deliberative democratic practices and their relevance for more participatory and deliberative-based policies in Indonesia's legislative system.
