Penyediaan tanah untuk pembangunan rumah susun sederhana sewa di Surakarta

Penelitian ini bertujuan untuk mengetahui dasar keputusan penunjukan tanah bekas makam di Kampung Begalon Kelurahan Panularan Kecamatan Laweyan Kota Surakarta sebagai lokasi pembangunan rumah susun sederhana sewa (Rusunawa), proses penyediaan tanahnya dan persiapan dalam pengaturan dan pengelolaan rusunawa, serta mengetahui pendapat warga masyarakat sekitar tanah bekas makam terhadap kebijaksanaan Pemerintah Kota Surakarta. Data yang digunakan adalah data primer dan data sekunder. Data primer diperoleh melalui penelitian lapangan (field research) dengan alat pengumpulan data wawancara dan kuesioner. Data sekunder diperoleh melalui studi dokumen (library research). Analisis dilakukan dengan metode deskriptif kualitatif dan penarikan kesimpulan dilakukan secara deduktif. Hasil penelitian menunjukkan, dasar keputusan penunjukan lokasi pembangunan rusunawa ini adalah SK Walikota Surakarta No. 648. 1/ 37/ 1/ 2003 Tanggal 15 April 2003 tentang Penetapan Lokasi Pembangunan Rumah Susun Sederhana Sewa (Rusunawa) di Kampung Begalon Kelurahan Panularan Kecamatan Laweyan, Surakarta. Proses penyediaan tanahnya sekalipun dilakukan oleh Pemerintah, pada pelaksanaannya tidak mempergunakan ketentuan UU No. 20 Th. 1961 tetang Pencabutan Hak-hak Atas Tanah dan Benda-benda Yang Ada Di Atasnya maupun Keppres No. 55 Th. 1993 tentang Pengadaan Tanah bagi Pelaksanaan Pembangunan Untuk Kepentingan Umum, karena tanah sebagai lokasi pembangunan rusunawa ini adalah tanah milik pemerintah yang terdaftar dengan Hak Pakai No. 8 atas nama Pemerintah Kota Surakarta. Berkaitan dengan pengaturan dan pengelolaan rusunawa, Pemerintah Kota Surakarta tengah menyusun Peraturan Daerah yang mengatur mengenai rumah susun khususnya Rusunawa. Pengelolaan Rusunawa akan diserahkan kepada DPU Kota Surakarta Sub Dinas Cipta Karya Seksi Penghunian dan Persewaan. Warga masyarakat sekitar tanah bekas makam yaitu warga RT 05 RW 03 Begalon menyatakan setuju dengan kebijaksanaan Pemerintah Kota Surakarta dengan alasan-alasan antara lain: 1. Demi tertibnya penggunaan tanah oleh yang berhak 2. Tidak merajalelanya permukiman liar 3. Menata lingkungan perumahan dan permukiman di Kampung Begalon supaya tidak terlihat kumuh

This research is aimed to know the base decision to choose the land of trace grave in Begalon, Panularan, Laweyan, Surakarta as the location of the development of these simple rent flat, the process of the served land, and the preparation in the way of arranging and managing these simple rent flat, also to know the view of the villagers around the trace grave with the policy taken by Surakarta’s local government. The used data are primary and secundary data. The primary data use trough field research by means of data collecting in the form of interview and questionaire. The secundary data use library research. The analysis is done by descriptive-qualitative methods and the conclusion use deductive methods. The result of the research presents, the base of decision of the choosing of the location of the simple rent flat is SK Walikota Surakarta No. 648. 1/ 37/ 1/ 2001, April, 15 th 2003 contenting the decision of the location of the development of the simple rent flat in the Begalon, Panularan, Laweyan, Surakarta. Although the prosess of the land serving is done by the government, in the process of execution, there are not used the rules as steted in the UU No. 20/ 1961 of annulment of the own rights of the land and things on them even Keppres No. 55/ 1993 of the land serving for executor of the development to public services is ignored, because the land used by the location of the development of the simple rent flat is the government land that is registered by the Use Right No. 8 in the name of Surakarta’s local government. Related to the arragement and management of the simple rent flat, Surakarta’s local government have been trying to construct a local decision related to the flat, especially, the simple rent flat. The management of the simple rent flat, will be handed by DPU of Surakarta’s local government Sub Dinas Cipta Karya of Settlement and Rent section. The member of society around the land of trace grave, that is the villagers of RT 05 RW 03 Begalon, states that they are agree to the policy taken by the Surakarta’s local goverment, by these reason as follows : 1. for the order of the land use by the owner 2. not to be over spreading of illegal settlement 3. to arrage the housing and settlement environment in the Begalon village so that they are not so slum.
