Legal Responsibility of Companies for the Negligence of Radiation Protection Officers and/or Radiographers Violating the Nuclear Energy Act

ABSTRACT
This study examines corporate legal responsibilities for the negligence of Radiation Protection Officers and/or Radiographers violating the Nuclear Energy Act. The research aims to analyze the extent of corporate liability under criminal, civil, and administrative law and identify the factors contributing to such negligence. The focus is to understand how violations in radiology services impact legal accountability and public safety, considering the regulatory framework established by Indonesia's nuclear safety laws.
This study employs an empirical-legal research method, using primary data obtained from interviews with radiation safety professionals and secondary data from regulations, academic literature, and case studies. The research combines statutory, conceptual, and case-based approaches, with qualitative data analysis presented descriptively.
The findings reveal that corporate liability is derived from principles such as vicarious liability, which links employee negligence to organizational accountability. Factors contributing to negligence include inadequate training, weak safety culture, ineffective supervision, and outdated radiology equipment. To address these challenges, the study recommends enhancing compliance through improved training, stricter internal controls, and modernized infrastructure to mitigate risks effectively.
