Penanggulangan Peredaran Kosmetik Ilegal Secara Non Penal Oleh BBPOM di Daerah Istimewa Yogyakarta

This study aims to determine the factors that cause the circulation of illegal cosmetics and examine the non-penal prevention of illegal cosmetics in the Special Region of Yogyakarta Province and the obstacles faced by BBPOM Yogyakarta in implementing non-penal prevention of illegal cosmetics in the Special Region of Yogyakarta.
This research is a descriptive empirical normative legal research. The data used in this study are primary data obtained from interviews with respondents who are related to the problem and secondary data obtained from library research on library materials that have been determined and are related to the topic of the problem raised by the author. Data analysis used in this study uses qualitative analysis.
Based on the results of the research and discussion conducted by the author, two conclusions can be drawn. First, the factors that cause the circulation of illegal cosmetics in the Special Region of Yogyakarta include economic factors, low compliance of business actors with regulations in the cosmetics sector, online trading of cosmetics through e-commerce, and lack of public awareness about safe cosmetics. Second, non-penal efforts to combat the circulation of illegal cosmetics have been carried out by the BBPOM in Yogyakarta in accordance with the duties and functions of the BBPOM Yogyakarta as regulated in laws and regulations but have not been carried out optimally due to obstacles. In efforts to combat the circulation of illegal cosmetics non-penal, the BBPOM in Yogyakarta makes efforts such as socialization and education, coaching, supervision of cosmetic production and distribution facilities, prevention and deterrence and cyber patrols. The implementation of non-penal efforts to combat the circulation of illegal cosmetics by the BBPOM Yogyakarta faces several obstacles, namely the number of facilities supervised in the Special Region of Yogyakarta is not comparable to the number of human resources, data on distribution facilities is difficult to obtain, and business actors are not cooperative.
