EKSPLOITASI PEKERJA MIGRAN PADA PERSIAPAN PIALA DUNIA QATAR 2022 DARI PERSPEKTIF TEORI KEADILAN JOHN RAWLS

Penelitian yang berjudul “Eksploitasi Pekerja Migran pada Persiapan Piala Dunia Qatar 2022 dari Perspektif Teori Keadilan John Rawls”, dilatarbelakangi oleh munculnya isu eksploitasi dan pelanggaran HAM pekerja migran pada pembangunan infrastruktur Piala Dunia Qatar 2022 yang menimbulkan berbagai macam ketidakadilan yang terjadi pada kehidupan pekerja migran. Penelitian ini bertujuan untuk memperoleh gambaran mengenai bentuk eksploitasi pekerja migran yang terjadi pada persiapan Piala Dunia Qatar 2022 dengan menggunakan perspektif teori keadilan John Rawls. 

Penelitian ini menggunakan metode penelitian kualitatif kefilsafatan dengan model studi kepustakaan dalam menjelaskan terjadinya eksploitasi pekerja migran pada persiapan Piala Dunia Qatar 2022 yang ditinjau melalui teori keadilan John Rawls. Penelitian ini termasuk jenis penelitian yang bersifat aktual dan dianalisis secara filosofis menggunakan metode hermeneutika filosofis. Penelitian ini dilakukan menggunakan beberapa tahapan, mulai dari persiapan, inventarisasi, klasifikasi, dan analisis. Unsur metodis yang akan digunakan dalam penelitian ini adalah deskripsi, interpretasi, dan refleksi filosofis.

Hasil yang dicapai dalam penelitian ini adalah: (1) Eksploitasi pekerja migran dalam persiapan Piala Dunia Qatar 2022 merupakan sebuah ketidakadilan yang bertentangan dengan prinsip-prinsip keadilan yang diperjuangkan oleh teori keadilan John Rawls. (2) Penerapan sistem kafala tidak sesuai dengan prinsip perbedaan Rawls, karena ketidakseimbangan distribusi sumber daya dan kekuasaan yang melibatkan kontrol kuat majikan kepada pekerja migran. Kebijakan yang dilakukan oleh Qatar dan FIFA telah mencerminkan konsep justice as fairness, akan tetapi implementasi kebijakan - kebijakan tersebut memerlukan kerjasama dan komitmen nyata dari pemerintah Qatar dengan pihak lain, dan juga membutuhkan pengawasan yang ketat dari masyarakat. 

The research titled "Exploitation of Migrant Workers in the Preparation of the Qatar 2022 World Cup from the Perspective of John Rawls Theory of Justice" is motivated by issues of exploitation and human rights violations of migrant workers in the construction of infrastructure for the Qatar 2022 World Cup, which have led to various injustices in the lives of migrant workers. This study aims to provide an overview of the forms of exploitation experienced by migrant workers in the preparation for the Qatar 2022 World Cup using John Rawls' theory of justice as a framework.

This research uses a qualitative research methodology in philosophy, employing a literature review model to explain the exploitation of migrant workers in the preparation for the Qatar 2022 World Cup, viewed through John Rawls theory of justice. The research is categorized as current affairs research and is analyzed philosophically using the method of philosophical hermeneutics. The research progresses through several stages, including preparation, inventory, classification, and analysis. Methodological elements employed in this research include description, interpretation, and philosophical reflection.

The findings of this research, (1) the exploitation of migrant workers in preparation for the 2022 FIFA World Cup Qatar represents an injustice contrary to the principles of justice advocated by John Rawls theory of justice. (2) The implementation of the kafala system does not align with Rawls' difference principle due to the imbalance in the distribution of resources and power, involving strong employer control over migrant workers. Policies enacted by Qatar and FIFA have reflected the concept of justice as fairness; however, effective policy implementation requires genuine cooperation and commitment from the Qatari government and other stakeholders, alongside rigorous oversight from the public.
