Pelindungan HAM bagi Anak Sebagai Kreator Konten Ditinjau dari Convention on the Rights of the Child oleh Negara Indonesia

Perkembangan teknologi yang semakin pesat, terlebih lagi di bidang sosial media memunculkan berbagai macam fenomena di dalamnya. Salah satu dampak dari perkembangan tersebut adalah kelahiran dari konten kreator anak. Konten kreator anak yang dalam aktivitas sosial medianya dihadapkan dengan berbagai macam peran, salah satunya sebagai endorser. Posisi anak sebagai kreator konten dan endorser ini dapat memunculkan potensi bagi anak-anak tersebut untuk mengalami eksploitasi, terutama eksploitasi ekonomi dimana hak-hak anak tersebut akan terancam pelindungan dan pemenuhannya. Penelitian ini akan merumuskan bagaimana Indonesia sebagai negara yang peratifikasi CRC melindungi hak-hak kreator konten anak tersebut dari eksploitasi.

Penelitian ini akan menggunakan metode pendekatan yuridis-normatif, mengandalkan dasar-dasar hukum yang telah mengatur hal-hal yang berkaitan untuk mengkaji masalah yang dirumuskan. Data-data yang ditemukan lalu akan diolah dengan teknik analisis model interaktif.

Hasil penelitian menunjukan bahwa kasus eksploitasi terhadap kreator konten anak telah terjadi, dan tidak terbatas dalam lingkup ekonomi saja, namun juga secara fisik dan mental. Selain itu ditarik juga kesimpulan bahwa eksploitasi ini memiliki potensi menjadi sesuatu yang lebih besar dan rutin dalam kehidupan anak. Maka dari itu dalam penelitian ini disarankan bahwa negara yang meratifikasi CRC, seperti Indonesia untuk menetapkan suatu dasar hukum yang meregulasi posisi anak dalam lingkup media sosial sebagai kreator konten agar pelindungan hak mereka dapat dijamin oleh negara.

The increasingly rapid development of technology, especially in the field of social media, has given rise to various phenomena in it. One of the impacts of this development is the creation of kids influencers. Kids influencers are faced with various roles in their social media presence, one of which is as an endorser. This role of kids influencers as endorsers can create the potential for these children to experience exploitation, especially economic exploitation where the protection and fulfillment of their children's rights will be threatened. This research will formulate how Indonesia as a country that has ratified the CRC protects the rights of children influencers from exploitation.

This research will use a juridical-normative approach method, relying on legal bases that regulate related matters to examine the problem formulated. The data found will then be processed using interactive model analysis.

The research results show that cases of exploitation of child influencers have occurred, and are not limited to the economic scope, but also physically and mentally. Apart from that, the conclusion was also drawn that this exploitation has the potential to become something bigger and more routine in children's lives. Therefore, in this research, it is recommended that countries that ratify the CRC, such as Indonesia, establish a legal basis that regulates kids influencers so that the protection of their rights can be guaranteed by the state.
