IMPLEMENTASI PENDAFTARAN TANAH SISTEMATIS LENGKAP (PTSL) TERHADAP TANAH TIMBUL (Studi Kasus di Desa Ketawang, Kecamatan Dolopo, Kabupaten Madiun)

Penelitian bertujuan, pertama untuk menganalisis implementasi Pendaftaran Tanah Sistematis Lengkap (PTSL) terhadap tanah timbul di Desa Ketawang, Kecamatan Dolopo, Kabupaten Madiun, kedua, untuk mengetahui dan menganalisis kendala yang dihadapi oleh masyarakat Desa Ketawang, Kecamatan Dolopo, Kabupaten Madiun dalam pendaftaran tanah sebagai upaya untuk mendapatkan tanda bukti kepemilikan hak atas tanah.

 

Metode penelitian berjenis Normatif-Empiris, jenis data yang dibutuhkan dalam penelitian ini adalah data primer dan data sekunder. Teknik dan alat pengumpulan data yang digunakan dalam penelitian tesis ini adalah wawancara dan studi dokumen. Data yang diperoleh dari hasil penelitian ini, akan dianalisis dengan menggunakan metode kualitatif.

 

Hasil penelitian menunjukkan bahwa pertama, penyelenggaraan PTSL terhadap tanah timbul telah dilakukan dalam dua tahap, yaitu pada tahun 2018 dan tahun 2021. Program PTSL tersebut telah diikuti setidaknya 250 peserta dan hingga tahun 2023 program tersebut telah mensertifikatkan 150 bidang tanah. Pelaksanaan PTSL dilakukan berdasarkan data yang diperoleh melalui satgas yuridis dan satgas fisik, kemudian ditindaklanjuti oleh panitia ajudikasi. Berdasarkan hasil yang diperoleh, wilayah Desa Ketawang masuk ke dalam kluster 1 (K1) dan kluster 3 (K3). Pelaksanaan kegiatan PTSL telah sesuai dengan tahapan yang diatur dalam Pasal 4 Permen ATR/BPN Nomor 6 Tahun 2018 tentang PTSL, kedua, kendala yang dihadapi dari pihak masyakarat antara lain banyak dari mereka yang sudah memiliki alas hak seperti Letter C namun nama pemegang Letter C tersebut masih atas nama orang lain, kendala dari Kantor Pertanahan Kabupaten Madiun terkait permohonan hak pada tanah timbul yang statusnya merupakan tanah negara melalui program PTSL adalah memastikan objek dan subjeknya. Kendala yang ketiga adalah kekeliruan nama data pemilik dan peta bidang lokasi pada saat penerbitan sertifikat program PTSL.

The research aims, firstly, to analyze the implementation of complete systematic land registration (PTSL) on channelbar in Ketawang Village, Dolopo District, Madiun Regency, secondly, to find out and analyze the obstacles faced by the people of Ketawang Village, Dolopo District, Madiun Regency in registering land as efforts to obtain proof of ownership of land rights.

 

The research method is Normative-Empirical type, the types of data needed in this research are primary data and secondary data. The data collection techniques and tools used in this thesis research are interviews and literature study. The data obtained from the results of this research will be analyzed using qualitative methods.

The research results show that first, the implementation of PTSL on emerging land was carried out in two stages, namely in 2018 and 2021. The PTSL program was attended by at least 250 participants and by 2023 the program had certified 150 plots of land. The implementation of PTSL is carried out based on data obtained through the juridical task force and physical task force, then followed up by the adjudication committee. Based on the results obtained, the Ketawang Village area is included in cluster 1 (K1) and cluster 3 (K3). The implementation of PTSL activities is in accordance with the stages regulated in Article 4 of the ATR/BPN Ministerial Regulation Number 6 of 2018 concerning PTSL, secondly, the obstacles faced by the community include many of them who already have basic rights such as Letter C but the name of the holder of the Letter C still in the name of another person, the obstacle for the Madiun Regency Land Office regarding the application for rights to land which has the status of state land through the PTSL program is ensuring the object and subject. The third obstacle is the incorrect name of the owner's data and map of the location field when issuing the PTSL program certificate.
