PENGAWASAN MAJELIS PENGAWAS TERHADAP KEABSAHAN PEMBACAAN AKTA OLEH ANGGOTA LUAR BIASA

Penelitian ini bertujuan untuk mengetahui dan menganalisis terkait pengawasan yang dilakukan oleh Majelis Pengawas Daerah terhadap Notaris yang mendelegasikan pembacaan Akta pada Anggota Luar Biasa serta implikasi terhadap akta tersebut apabila pembacaannya tidak dilakukan oleh Notaris yang bersangkutan.

Jenis penelitian yang digunakan dalam penulisan hukum ini adalah penelitian normatif empiris. Data sekunder yang digunakan diperoleh dari studi kepustakaan dan data primer diperoleh dari studi lapangan yakni wawancara yang dilakukan terhadap narasumber serta responden yang berkaitan yakni Majelis Pengawas Daerah serta Anggota Luar Biasa. Data-data yang diperoleh kemudian dianalisis secara kualitatif.

Berdasarkan hasil penelitian pengawasan yang dilakukan oleh MPD kepada Notaris menggunakan metode berjenjang, pertama pengawasan administratif, kedua pengawasan langsung, dan terakhir pengawasan represif. Pengawasan yang dilakukan oleh MPD bersifat aktif-proaktif, aktif dalam hal melakukan pembinaan proaktif ketika terdapat kasus atau pengaduan yang diajukan oleh masyarakat. Terhadap Notaris yang mendelegasikan pembacaan Aktanya kepada ALB atau pihak lain dapat dikenakan sanksi administratif hingga yang paling berat pemberhentian. Pada Akta Notaris yang pembacaannya tidak dilakukan secara langsung oleh Notaris, Akta tersebut tetap sah namun bentuknya terdegradasi menjadi Akta di bawah tangan yang berimplikasi pada beberapa hal yakni kekuatan pembuktian, proses pembuktian, keabsahan Akta, proses eksekusi, serta kepercayaan publik terhadap Notaris serta produk yang dihasilkan.

This research aims to find out and analyze the supervision carried out by the Regional Supervisory Council against Notaries who delegate the reading of the Deed to Extraordinary Members and the implications for the deed if the reading is not carried out by the Notary concerned.

The type of research used in this Thesis is normative empirical research. Secondary data used is obtained from literature studies and primary data is obtained from field studies, namely interviews conducted with relevant sources and respondents, namely the Regional Supervisory Council and Extraordinary Members. Then Writer analyzed data with qualitative method.

According to the research results, the supervision conducted by MPD to Notary uses a tiered method, first administrative supervision, second direct supervision, and last repressive supervision. Supervision conducted by MPD is active-proactive, active in terms of conducting proactive coaching when there are cases or complaints filed by the public. Notaries who delegate the reading of their deeds to ALB or other parties may be subject to administrative sanctions up to the most severe dismissal. In a Notarial Deed where the reading is not done directly by the Notary, the Deed remains valid but the form is degraded into an underhand Deed which has implications for several things, namely the strength of proof, the process of proof, the validity of the Deed, the execution process, and public trust in the Notary and the products produced.
