Membedah serta menguraikan kelemahan penyelesaian sengketa hasil Pilpres berkaitan dengan pelanggaran terstruktur sistematis dan masif serta memberikan gagasan baru dalam bentuk rekonseptualisasi penyelesaian sengketa Pilpres berkaitan dengan pelanggaran Pemilu terstruktur sistematis dan masif. Undang-Undang Nomor 7 Tahun 2017 tentang Pemilihaan Umum sejatinya telah mengkonstruksikan norma kompetensi untuk memeriksa pelanggaran pemilu TSM berada di Bawaslu sebagaimana diatur pada Pasal 286 dan Pasal 463. Akan tetapi permasalahan muncul ketika Pemohon pada perkara Pilpres mendalilkan bahwa Mahkamah Konstitusi tetap memiliki kompetensi untuk mengadili pelanggaran Pemilu TSM.
Dissecting and describing the weaknesses of the dispute resolution of the presidential election results related to systematic and massive structured violations and providing new ideas in the form of reconceptualization of the presidential election dispute resolution related to systematic and massive structured election violations. Law Number 7/2017 on General Elections has actually constructed the norm of competence to examine TSM election violations in Bawaslu as stipulated in Article 286 and Article 463. However, problems arise when the Petitioner in the Presidential Election case argues that the Constitutional Court still has the competence to hear TSM election violations.This research is a normative legal research (doctrinal legal research) and this research is descriptive in nature using three approaches, first, statute approach, second, conceptual approach, and third, case approach. There are 2 results in this study, including: First, the weakness in the seeker of justice to make efforts to resolve presidential election disputes on TSM violations that have great potential to change the outcome of the victory of the presidential election candidate pair. Because in fact in the context of the implementation of Bawaslu's authority in the process of handling administrative violations that occur in TSM still has several problems. Even though the case has been resolved by Bawaslu, in practice, the election administration violations that occur in TSM still lead to the Constitutional Court. Furthermore, the judicial institution of the Constitutional Court which causes cases to enter the Constitutional Court which are actually matters of criminal acts and election administration is the result of the interpretation of the Constitutional Court itself in Decision Number 41/PHPU.D-VI/2008; Second, The reconceptualization offered by the author is in this context, namely the authority to be able to resolve PHPU owned by the Constitutional Court needs to be maximized, then it should be formed specific provisions for the Constitutional Court in handling disputes over TSM violations: 1) Amendments are made to the Election Law to limit Bawaslu and give concrete authority to the Constitutional Court regarding the settlement of TSM violations; 2) The establishment of the Constitutional Court Procedural Law so that it no longer uses regulations formed internally, namely PMK, but at the Law level to regulate the technical settlement and litigation flow in the Constitutional Court, especially in TSM violations.This research has suggestions that constitutional testing can be carried out by the Constitutional Court regarding Bawaslu's authority to adjudicate TSM election violations through the authority to review the constitutionality of the law. Even the Constitutional Court based on previous decisions on handling TSM election violations can also be used as input and consideration by lawmakers that disputes over TSM presidential election violations are a form of violation that is quite complex.
