The purpose of this research is to analyze and understand the position of couriers as intermediaries between sellers and buyers in online transactions, particularly in the cash-on-delivery (COD) payment system. This study also aims to identify forms of legal protection that can be provided to couriers who directly interact with buyers in the COD payment system. The research utilizes normative legal methods, focusing on document studies and literature related to the position and legal protection of couriers, supplemented by interviews with Shopee Express couriers, faculty members from the Faculty of Law at Universitas Sultan Agung Semarang, and employees from Tokopedia.
The research findings demonstrate that the position of couriers as intermediaries in online transactions is governed by a mixed partnership or agency-based agreement with Shopee Express (SPX), where couriers are responsible for delivering packages and receiving payments, while safeguarding customer information confidentiality and the company's image. Legal protection for Shopee Express couriers includes a no-premium work insurance program and occupational safety training (K3) to maintain their well-being and enhance their skills in performing their duties safely.
In conclusion, couriers in the online trading system with Shopee Express (SPX) operate under a partnership or agency agreement, with responsibilities for package delivery and payment collection. To support courier welfare, SPX provides a no-premium work insurance program and occupational safety training (K3) to enhance awareness and skills in safe task execution.
