Pelaksanaan Keadilan Restoratif dalam Penanganan Perkara Pidana di Wilayah Hukum Kepolisian Resor Kulon Progo

Penelitian ini bertujuan untuk mengetahui dan menganalisis pelaksanaan keadilan restoratif dalam penanganan perkara pidana di wilayah hukum Polres Kulon Progo. Penelitian ini mencakup implementasi keadilan restoratif oleh penyidik, problematika yang dihadapi, serta proyeksi penanganan perkara melalui keadilan restoratif di masa depan. Metode penelitian yang digunakan adalah kombinasi antara penelitian hukum normatif dan empiris. Penelitian hukum normatif dilakukan untuk mengumpulkan data sekunder, sedangkan penelitian empiris dilakukan untuk memperoleh data primer di lapangan terkait proses penyidikan. Penelitian ini bersifat deskriptif analitis, yang bertujuan untuk menggambarkan dan menemukan fakta-fakta hukum secara menyeluruh, serta mengkaji secara sistematis peraturan hukum positif yang berkaitan dengan keadilan restoratif dan kebijakan pelaksanaannya. Hasil penelitian menunjukkan bahwa: Pertama, implementasi keadilan restoratif oleh Penyidik Polres Kulon Progo telah menunjukkan perkembangan positif terlihat dari meningkatnya jumlah perkara yang diselesaikan melalui mekanisme keadilan restoratif. Kedua, penyidik Polres Kulonprogo menghadapi beberapa problematika yang erat kaitannya dengan pemahaman terbatas tentang Keadilan Restoratif, baik oleh masyarakat maupun penyidik. Beberapa penyidik masih memiliki pemahaman yang terbatas mengenai konsep, prinsip, dan prosedur keadilan restoratif. Hal ini dapat menghambat proses identifikasi perkara yang layak diselesaikan melalui keadilan restoratif, serta pelaksanaan tahapantahapannya secara efektif. Ketiga, penanganan perkara pidana melalui keadilan restoratif di Polres Kulon Progo ke depannya perlu memperhatikan aspek penguatan kapasitas penyidik untuk meningkatkan efektifitas dan keberlanjutannya

This research aims to examine and analyze the implementation of restorative justice in the handling of criminal cases within the jurisdiction of the Kulon Progo Police Department. The research encompasses the implementation of restorative justice by investigators, the challenges encountered, and the projection of case handling through restorative justice in the future. The research methodology employed is a combination of normative and empirical legal research. Normative legal research is conducted to collect secondary data, while empirical research is carried out to obtain primary data in the field regarding the investigation process. This research is descriptive and analytical in nature, aiming to comprehensively describe and uncover legal facts, as well as systematically examine positive legal regulations related to restorative justice and its implementation policies. The research findings indicate the following: First, the implementation of restorative justice by investigators at the Kulon Progo Police Department has shown positive developments, as evidenced by the increasing number of cases resolved through restorative justice mechanisms. Second, investigators at the Kulon Progo Police Department face several challenges closely related to a limited understanding of restorative justice, both by the community and investigators. Some investigators still have a limited understanding of the concept, principles, and procedures of restorative justice. This can hinder the process of identifying cases suitable for resolution through restorative justice, as well as the effective implementation of its stages. Third, the handling of criminal cases through restorative justice at the Kulon Progo Police Department in the future needs to consider aspects of strengthening investigators' capacity to enhance its effectiveness and sustainability.
