Fungsi dan tugas Badan Perwakilan Desa dalam penyelenggaraan pemerintahan desa

Pendekatan sentralistis top down selama puluhan tahun, membawa pengaruh besar dalam sistem pemerintahan termasuk di tingkat desa. Pemerintah Desa lebih berperan sebagai agen Pemerintah Pusat daripada sebagai pelayan masyarakat. Forum musyawarah adat dan institusi lokal digantikan lembaga formal secara seragam oleh Pemerintah yang ternyata tidak efektif, karena tidak sesuai dengan kultur lokal. Masyarakat desa tidak bisa mengawasi Pemerintah Desa, karena Kepala Desa bertanggung jawab kepada Bupati bukan kepada rakyat. LMD juga tidak mempunyai hak pengawasan, sehingga kontrol terhadap Pemerintah Desa lemah. Akibatnya upaya mengembangkan good governance di desa menjadi terhambat. Penyelenggaraan Pemerintahan desa mengalami reformasi, yang antara lain ditandai keberadaan BPD, sebagai mitrakerja sekaligus melakukan pengawasan terhadap Pemerintah Desa. Tujuan penelitian ini untuk mengetahui pelaksanaan fungsi dan tugas BPD, khususnya fungsi pengawasan BPD dalam penyelenggaraan Pemerintahan Desa dan peran BPD dalam mewujudkan pemerintahan yang baik di Desa. Metode Penelitian yang digunakan adalah penelitian dekriptif kualitatif. Metode pengumpulan data dilakukan dengan pengamatan, wawancara dan dokumentasi. Pemilihan informan dengan teknik purposive dan bola salju. Sedangkan yang menjadi obyek penelitian antara lain Lurah Desa, Perangkat Desa, Anggota BPD, dan Tokoh Masyarakat. Hasil penelitian ini antara lain bahwa dengan adanya fungsi pengawasan BPD, maka Lurah Desa tidak lagi terlalu dominan dan sulit dikontrol. Undang-Undang dan Perda belum secara tegas mengatur batas kewenangan dan mekanisme pengawasan oleh BPD, sehingga menimbulkan penafsiran yang berbeda-beda. BPD sudah menjalankan fungsi yang dimilikinya, namun sebagian belum dilaksanakan secara optimal. Tingkat pengetahuan, pemahaman dan kesadaran Anggota BPD dan Lurah Desa terhadap UU No. 22 tahun 1999 belum optimal. Pengawasan yang dilakukan oleh BPD dimulai sejak proses pembuatan kebijakan sampai tahap evaluasi. BPD cukup berperan dalam mengembangkan good governance, melalaui upaya : mendukung terwujudnya Akuntabilitas Pemerintahan Desa, peningkatan transparansi, peningkatan partisipasi masyarakat dan penegakan supremasi hukum. Penelitian ini belum bisa mengungkap hal yang lebih dalam, karena keberadaan BPD belum lama, yaitu sekitar 2 (dua) tahun. Rekomendasi yang ditawarkan yaitu : Perlunya diatur lebih jelas dalam Perda tentang mekanisme dan batas kewenangan pengawasan BPD. Perlunya peningkatan kinerja BPD dalam menjalankan tugas dan fungsinya. Pemahaman anggota BPD dalam melaksanakan fungsi pengawasan harus ditingkatkan, melalui pemberian pembekalan tambahan bagi anggota BPD. Perlunya peningkatan kesadaran dan pemahaman Lurah dan pamong Desa terhadap UU Nomor 22 Tahun 1999, terutama terkait dengan tugas, fungsi dan kewenangan BPD. Peran masyarakat dan kelembagaan Desa dalam mengembangkan good governance di desa harus ditingkatkan, Pemerintah desa juga harus membuka diri pada organisasi masyarakat yang kritis sekalipun, karena mungkin akan memberi input positif bagi kemajuan desa.

The centralistic approach of top down for tens of years, bringing a big influences in governmental system including in district level. The countryside government is more shared as the agent of center government than as a society servant. The Custom deliberation forum and the local institution is replaced by formal institution simultaneously by government which is not effective, because it is not compatible with local cultures. The human of the village can’t control the countryside government, because the chief of the district is responsible to the regent not to the society. The Countryside Deliberation Institution (LMD) does not have a rights to control, so the controlling toward the chief of the district is low. Because of that in developing a good governance in the district become pursued. In managing the countryside government must be getting reformation, It is made a Countryside Delegation Board (BPD) existence, as the work partner who conduct the controlling toward Countryside government. The aim of this study is to know the implementation of the functions and the tasks of BPD, especially the function of BPD controlling in implementing of Countryside government and also to know the role of BPD in making a good governance in the village. The used study method is the study of qualitative descriptive. The data collected method is conducted by observation, interview, and documentation. The informan selecting is used purposive technique and snowball . While the object of the study are the chief of district, district staff, the member of BPD and society figure. The result of the study found that there are a function of BPD controlling, so the chief of the village is not more dominant and controlled easily. There are no ordinance and village rules which regulates the boundaries of authority and the controlling mechanism by BPD, so it makes a interpretation differences. BPD have conducted its function, but it hasn’t been conducted optimally. There are not enough knowledge level, understanding and awareness of the BPD members and the chief of the district toward the ordinance no. 22 of the year 1999 unoptimally. The controlling which is conducted by BPD begun since policy making process to evaluation phase. BPD shares enough in developing a good governance through: supporting in making accountability of the Countryside government, transparences improvement, society participation improvement, and straightening of law supremacies. This study can not express the deeper matter yet, because BPD hasn’t been long its existences. It is about 2 (two) years. The offered recommendations are : the importance of arranged in village rules clearly about the mechanism and the boundaries of authority on BPD controlling. The importance of development BPD performance in operating the tasks and the functions. The understanding of BPD members in doing the controlling functions must be improved through the given of additional purchasing for BPD members. The importance of awareness improvement and understanding the chief of district and his staff toward Ordinance no. 22 of the year 1999, especially which deal with their tasks, functions and authorities of BPD. Society role and district institution in developing a good governance in the district must be improved. The Countryside government must open themselves to the critical society organization, because they will give a positive input for district progress.
