PENGARUH PERUBAHAN PROSES ANALISIS MENGENAI DAMPAK LINGKUNGAN (AMDAL) DALAM UNDANG-UNDANG NOMOR 6 TAHUN 2023 TENTANG CIPTA KERJA TERHADAP RUANG PARTISIPASI MASYARAKAT

Perubahan Pasal 26 Undang-Undang Nomor 6 Tahun 2023 tentang Cipta Kerja (UUCK 6/2023) yang mengatur tentang proses Amdal pemberian ruang partisipasi masyarakat dalam proses Amdal dan perizinan lingkungan baik dalam tataran undang-undang, maupun peraturan pelaksananya. Penelitian ini bertujuan untuk menganalisis perubahan proses Amdal terhadap ruang partisipasi masyarakat pada tataran peraturan turunan dan implementasi pada praktik pelibatan masyarakat serta implikasi perubahan proses Amdal terhadap ruang partisipasi masyarakat. Jenis penelitian yang digunakan dalam penelitian ini adalah hukum normatif dengan menggunakan data primer berupa hasil wawancara dan data sekunder dari studi literatur terhadap bahan-bahan hukum. Pendekatan yang digunakan dalam penelitian ini terdiri dari pendekatan perundang-undangan dan pendekatan konseptual. Penelitian ini memperoleh beberapa penjelasan, yaitu Pertama, proses penyusunan Amdal mengalami perubahan dari konsep perizinan menjadi persetujuan, tata waktu proses Amdal, dan penilaian dokumen Amdal. Perubahan ini berdampak pada pemberian ruang partisipasi masyarakat di tahap pengumuman, konsultasi publik, dan penilaian dokumen Amdal. Kedua, perubahan ruang partisipasi terhadap partisipasi masyarakat berimplikasi pada analisis ilmiah dokumen Amdal berkenaan dengan penggunaan paradigma dan hasil penilaian kualitas ilmiah dokumen Amdal, penyelenggaraan pemerintahan yang baik, pemenuhan dan perlindungan hak asasi manusia baik dari segi hak substantif maupun hak prosedural, penyelenggaraan ekonomi nasional, dan penegakan hukum. Kesimpulan yang diperoleh adalah perubahan pengaturan tentang proses Amdal di rezim UUCK 6/2023 berdampak signifikan terhadap pemberian ruang partisipasi masyarakat baik dalam tataran norma maupun praktik, serta berimplikasi terhadap aspek teknis, birokrasi, hak asasi manusia, ekonomi nasional, dan penegakan hukum.

The changes to Article 26 of Law Number 6 of 2023 concerning Job Creation (UUCK 6/2023) which regulates the EIA process provide space for community participation in the EIA process and environmental licensing both at the level of the law, and its implementing regulations. This research aims to analyze changes in the EIA process towards community participation space at the level of derivative regulations and implementation in the practice of community involvement and the implications of changes in the EIA process for community participation space. The type of research used in this research is normative law using primary data in the form of interview results and secondary data from literature studies on legal materials. The approach used in this research consists of a statutory approach and conceptual approach. There are two explanations obtained from this research. First, the process of preparing EIA has changed from the concept of licensing to approval, the timeframe for the EIA process, and the assessment of EIA documents. These changes have an impact on providing space for community participation in the announcement, public consultation, and assessment stages of EIA documents. Next, changes in participation space for community participation have implications for the scientific analysis of EIA documents regarding the use of paradigms and the results of assessing the scientific quality of EIA documents, good governance, fulfillment and protection of human rights both in terms of substantive rights and procedural rights, national economic administration, and law enforcement. The conclusion obtained is that changes in the regulation of the EIA process in the Law 6/2023 regime have a significant impact on providing space for community participation both at the level of norms and practices, and have implications for technical aspects, bureaucracy, human rights, national economy, and law enforcement.
