Asas Penghargaan atas Pendapat Anak sebagai Pertimbangan Hakim dalam Penetapan Dispensasi Kawin (Studi Penetapan Pengadilan Agama Buol Nomor 72/Pdt.P/2020/PA Buol)

Penelitian ini bertujuan untuk mengetahui penerapan Asas Penghargaan atas Pendapat Anak sebagai pertimbangan Hakim dalam penetapan Dispensasi Kawin dalam Penetapan Pengadilan Agama Buol Nomor 72/Pdt.P/2020/PA Buol. Penelitian ini berfokus pada dua poin yaitu penerapan Asas Penghargaan atas Pendapat Anak dalam Penetapan Pengadilan Agama Buol Nomor 72/Pdt.P/2020/PA Buol dan implikasi hukum dari penerapan Asas Penghargaan atas Pendapat Anak dalam Penetapan Pengadilan Agama Buol Nomor 72/Pdt.P/2020/PA Buol.

Penelitian ini adalah penelitian hukum normatif dengan sifat penelitian deskriptif. Metode penelitian yang digunakan dalam penelitian ini adalah metode kualitatif dalam bentuk studi pustaka dan wawancara dengan narasumber. Data dalam penelitian ini didapat dari dokumen yang berupa bahan hukum berupa buku, jurnal, undang-undang, dan dokumen pendukung lainnya serta hasil wawancara dengan narasumber. Data yang telah terkumpul kemudian dianalisis menggunakan metode kualitatif.

Hasil penelitian ini menjelaskan bahwa dalam penetapan tersebut, Hakim telah menerapkan Asas Penghargaan atas Pendapat Anak, secara formal. Hal tersebut dapat dilihat dalam beberapa keterangan anak maupun saksi yang dicantumkan dalam penetapan. Namun secara substantif, asas ini belum diterapkan secara tepat karena tidak digali keterangan anak perempuan untuk mengetahui kondisi anak perempuan, serta pemahaman dan ada atau tidaknya paksaan terkait perkawinan terhadap anak perempuan. Implikasi hukum dari penerapan Asas Penghargaan atas Pendapat Anak dalam Penetapan tersebut adalah Penetapan tersebut harus tetap dilaksanakan karena berlaku Asas res judicata pro vitate habetur (putusan Hakim harus dianggap benar) kecuali diputus lain oleh pengadilan yang lebih tinggi.

This study aims to determine the application of the Principle of Respect for Children's Opinions as a consideration of Judges in determining Marriage Dispensation in the Determination of the Buol Religious Court Number 72/Pdt.P/2020/PA Buol. This research focuses on two points, namely the application of the Principle of Respect for Children's Opinions in the Buol Religious Court Determination Number 72/Pdt.P/2020/PA Buol and the legal implications of the application of the Principle of Respect for Children's Opinions in the Buol Religious Court Determination Number 72/Pdt.P/2020/PA Buol.

This research is a normative legal research with descriptive research nature. The research method used in this research is a qualitative method in the form of literature study and interviews with sources. The data in this research is obtained from documents in the form of legal materials in the form of books, journals, laws, and other supporting documents and the results of interviews with sources. The data that has been collected is then analyzed using qualitative methods.

The results of this study explain that in the decision, the judge has formally applied the principle of respect for children's opinions. This can be seen in several testimonies of children and witnesses included in the decision. However, substantively, this principle has not been applied properly because the girl's testimony was not explored to find out the girl's condition, as well as her understanding and the presence or absence of coercion related to the marriage of the girl. The legal implication of the application of the Principle of Respect for Children's Opinions in the Stipulation is that the Stipulation must still be implemented because the principle of res judicata pro vitate habetur (the Judge's decision must be considered correct) applies unless decided otherwise by a higher court.
