      Produksi Hulu Minyak dan Gas Bumi merupakan salah satu pilar utama pendapatan negara dalam membangun perekonomian di Republik Indonesia bagi kesejahteraan rakyat. Salah satu hasil hulu Minyak dan Gas Bumi adalah Produk Ikutan yang terkandung di dalamnya. Namun, dalam kebijakan penentuan harga Produk Ikutan oleh SKK Migas yang terkandung dalam Surat Keputusan SKK Migas No. Kep-0017/SKKMA0000/2022/S9 tentang Penjualan Produk Ikutan Kegiatan Usaha Hulu Minyak Dan Gas Bumi (“SK 0017”) masih dipandang melampaui kewenangan karena SKK Migas tidak memiliki kewenangan untuk menentukan kebijakan harga berdasarkan peraturan perundang-undangan. Oleh karena hal tersebut, penulis termotivasi untuk melakukan penelitian ini dengan tujuan untuk mengetahui bagaimana alas hak penerbitan SK 0017 berdasarkan kewenangan yang dimiliki SKK Migas serta implikasi terhadap perjanjian jual beli Produk Ikutan antara KKKS dan Pembeli.

      Penelitian yang Penulis lakukan berjenis yuridis normatif yaitu suatu penelitian yang bertujuan untuk mensinkronisasikan ketentuan-ketentuan hukum yang berlaku dengan kaidah-kaidah yang berlaku dengan kaitannya dalam penerapan peraturan-peraturan hukum itu pada praktik nyatanya di lapangan

      Hasil penelitian ini adalah SKK Migas hanya memiliki kewenangan terikat berdasarkan peraturan perundang-undangan (legal representative) yang mana tidak memiliki kewenangan untuk menetapkan harga Produk Ikutan. Sehingga, SK 0017 tidak sepenuhnya mengikuti asas AUPB terkhususnya asas kepastian hukum dan asas tidak menyalahgunakan wewenang. Pelanggaran terhadap asas AUPB tersebut berpotensi dapat dijadikan sebagai dasar gugatan Tata Usaha Negara. Namun demikian, sepanjang belum adanya gugatan dan belum adanya putusan PTUN yang sah dan mengikat,,KKKS dan Pembeli tetap menaati SK 0017 dan atas perjanjian jual beli yang telah disepakati tetap berlaku dan mengikat (pacta sunt servanda). 

      Upstream Oil and Gas Production is one of the main pillars of state revenue in developing the economy in the Republic of Indonesia for the people’s welfare. One of the upstream products of Oil and Gas is the By-products contained therein. However, in the policy for determining prices of By-products y SKK Migas as stipulated in SKK Migas Decree No. Kep-0017/SKKMA0000/2022/S9 regarding The Sales of By-products of Upstream Oil and Gas Business Activities ("SK 0017") is still considered to exceed its authority because SKK Migas does not have the authority to determine prices based on statutory regulations. Because of this, the Author was motivated to conduct this research with the aim of finding out how the title of rights in issuance of SK 0017 are based on the authority possessed by SKK Migas as well as the implications for the By-products sale and purchase agreement between KKKS and the Buyer.

      The research that the Author conducted is a normative juridical type, namely research that aims to synchronize applicable legal provisions with applicable rules in relation to the application of these legal regulations in actual practice.

      The results of this research are that SKK Migas has limited authority based on statutory regulations (legal representative) which does not have the authority to determine prices for By-products. Thus, SK 0017 does not fully follow the AUPB principles, especially the principle of legal certainty and the principle of not abusing authority. Violations of the AUPB principles can potentially be used as the basis for a State Administrative lawsuit. However, as long as there is no lawsuit and there is no legal and binding PTUN decision, KKKS and the Buyer shall comply with SK 0017 and the agreed sale and purchase agreement will remain valid and binding (pacta sunt servanda).
