Implementasi Pemeriksaan Awal Mengenai Persyaratan Gugatan Perwakilan Kelompok (Studi Kasus Perkara Putusan Pengadilan No. 174/Pdt.G/2022/PN. Sda)

Penelitian ini bertujuan untuk mengetahui secara spesifik tentang implementasi persyaratan dalam menggunakan gugatan perwakilan kelompok yang diperiksa dalam proses pemeriksaan awal sesuai dengan ketentuan di dalam PERMA No. 1 Tahun 2002 tentang Acara Gugatan Perwakilan Kelompok. Penelitian ini juga bertujuan untuk memahami penafsiran terhadap persyaratan gugatan perwakilan kelompok. Berdasarkan kenyataan di lapangan sering dijumpai ketidaksamaan penafsiran tersebut dan menyebabkan banyak gugatan dinyatakan tidak sah dalam menggunakan acara gugatan perwakilan kelompok. Penelitian ini menggunakan studi kasus Putusan Pengadilan Negeri Sidoarjo Nomor 174/Pdt.G/2022/PN. Sda. Pihak yang berperkara ialah Henny Ariestyanti, S.E. selaku wakil kelompok dari kelompok warga masyarakat yang membeli tanah kavling Perumahan de Milenium melawan Heru Sutanto selaku Tergugat I dan pengembang Perumahan de Milenium, Rifa’atul Mahmudah selaku Tergugat II dan istri dari pemilik Pondok Pesantren Modern Al Amanah, dan Teguh Waskito, S.H., M.Kn. Selaku Turut Tergugat dan notaris yang menangani jual beli tanah antara Heru Sutanto dengan Rifa’atul Mahmudah.

Penelitian ini menggunakan jenis penelitian yuridis empiris dengan sifat deskriptif. Pada penelitian ini, jenis data yang digunakan adalah jenis data primer yang didapatkan melalui proses wawancara dengan responden dan jenis data sekunder yang berupa peraturan perundang-undangan dan bahan hukum lainnya yang didapatkan melalui studi kepustakaan.

Hasil dari penelitian ini menunjukkan bahwa gugatan Penggugat diputus tidak sah karena 2 (dua) alasan utama. Kedua alasan tersebut adalah gugatan tidak memenuhi ketentuan Pasal 2 huruf (a) maupun huruf (b) PERMA No. 1 Tahun 2002. Alasan gugatan tidak memenuhi Pasal 2 huruf (a) ialah gugatan tidak efisien sebagai gugatan perwakilan kelompok. Alasan gugatan tidak memenuhi Pasal 2 huruf (b) ialah tidak adanya kesamaan jenis gugatan antara wakil kelompok dengan anggota kelompok.

This research aims to find out specifically about implementation of requirements for using class action which is examined in the process of certification based on PERMA No. 1 of 2002 about class action procedure. This research also aims to understand interpretation on class action requirements. Based on reality from the field, there are different interpretations which made many lawsuit weren’t valid for using class action procedure.  This research is based on case study of Sidoarjo District Court Decision No. 174/Pdt.G/2022/PN. Sda. The litigants are Henny Ariestyanti, S.E.  as the plaintiff  and as the class representative for the class of community members who buy residential plot at de Milenium Housing Complex, Heru Sutanto as the Defendant I and as the developer of de Milenium housing complex, Rifa’atul Mahmudah as the Defendant II and as the wife of the Al Amanah Modern Islamic Boarding School’s owner, and Teguh Waskito, S.H., M.Kn. As the co-defendant and as the notary who handles the Rifa’atul Mahmudah’s land purchase from Heru Sutanto.

This research is juridical empirical research with descriptive type of research. The primary data of this research was obtained through interview with the respondents and the secondary data of this research was obtained through literature study which is in the form of legislation and other legal materials.

This research found the plaintiff’s lawsuit is ruled invalid by the judge with 2 (two) main reasons. Those two reasons are the plaintiff’s lawsuit does not meet the provisions of Rule 2 letter (a) and letter (b) PERMA No. 1 of 2002. In cause of Rule letter (a) is not fulfilled by the plaintiff’s lawsuit, the judges have considered the lawsuit is not efficient as class action lawsuit. For the Rule 2 letter (b), the plaintiff’s lawsuit does not meet typicality as the one of the requirements in using class action lawsuit.
