Kepastian Hukum Terhadap Pengaturan Hak Pekerja Outsourcing Atas Keselamatan Dan Kesehatan Kerja (K3)

Penelitian ini
bertujuan untuk mengetahui dan menganalisis
pengaturan terkait hak pekerja outsourcing
atas Keselamatan dan Kesehatan Kerja (K3) berdasarkan peraturan ketenagakerjaan
di Indonesia. Tujuan lain dari penelitian ini untuk mengetahui dan menganalisis
kepastian hukum hak pekerja outsourcing
atas Keselamatan dan Kesehatan Kerja (K3) berdasarkan pengaturan
ketenagakerjaan di Indonesia.
Penelitian ini
berjenis normatif dan bersifat deskriptif dengan menganalisis data primer dan
data sekunder atas berbagai bahan hukum. Data primer dan data sekunder
diperoleh dari penelitian kepustakaan dengan cara studi pustaka atau studi
dokumen, serta melakukan wawancara secara mendalam terhadap akademisi yang
memiliki keahlian pada bidang hukum ketenagakerjaan. Hasil dari data tersebut,
diolah dan dianalisis secara kualitatif dengan metode penalaran hukum
induktif-deduktif sehingga diuraikan secara deskriptif dan penyimpulan naratif.
Dari hasil
penelitian, ditemukan bahwa: Pertama, Pengaturan terkait hak pekerja outsourcing
atas Keselamatan dan Kesehatan Kerja (K3) berdasarkan peraturan ketenagakerjaan
di Indonesia secara eksplisit belum ada pengaturannya. Sebab peraturan terkait outsourcing
dalam Pasal 66 ayat (2) Undang-Undang Nomor 6 Tahun 2023 tentang Cipta Kerja
secara eksplisit tidak menyatakan frasa pelindungan atas “Keselamatan dan
Kesehatan Kerja (K3)”, sehingga belum ada pengaturan mengenai Keselamatan dan
Kesehatan Kerja (K3) terhadap pekerja outsourcing di Indonesia. Kedua,
Kepastian hukum terkait hak
pekerja outsourcing atas Keselamatan dan Kesehatan Kerja (K3) masih menimbulkan
persoalan, karena belum adanya peraturan mengenai Keselamatan dan Kesehatan
Kerja (K3) terhadap pekerja outsourcing sehingga menimbulkan
ketidakpastian hukum dalam penerapnya. Berdasarkan beberapa contoh kasus dalam
penelitian ini pelaksanaan pemenuhan hak Keselamatan dan Kesehatan Kerja (K3)
bagi pekerja outsourcing dibuat secara mandiri berdasarkan inisiatif
antara perusahaan outsourcing dengan perusahaan user yang
dituangkan secara tertulis dalam surat perjanjian agar memberikan kepastian
hukum.
The research aims to analyze the arrangements related to
outsourced workers rights to occupational safety and health based on labour
regulations in Indonesia. This research is also to analyze the legal certainty
of outsourced workers rights to occupational safety and health based on labour
regulations in Indonesia.
This research adopts a normative and descriptive
approach, utilizing primary and secondary data from various legal sources.
Primary data and secondary data are obtained from library research by means of
literature study or document study, as well as conducting in-depth interviews
with academics who have expertise in the field of Labour law. The collected
data is qualitatively processed and analyzed using inductive-deductive legal
reasoning methods, leading to descriptive and narrative conclusions.
The research finds: First,
Arrangements related to outsourced workers' rights to Occupational Safety and
Health (OHS) based on labour regulations in Indonesia explicitly do not yet
exist. Because the regulation related to outsourcing in Article 66 paragraph
(2) of Law Number 6 Year 2023 on Job Creation explicitly does not state the
phrase protection of "Occupational Safety and Health (K3)", so there
is no regulation regarding Occupational Safety and Health (K3) for outsourced
workers in Indonesia. Second, Legal certainty regarding outsourced workers'
rights to Occupational Safety and Health (OHS) still raises issues, because
there are no regulations regarding Occupational Safety and Health (OHS) for
outsourced workers, causing legal uncertainty in its application. Based
on several case examples in this study, the implementation of the fulfillment
of Occupational Safety and Health (OHS) rights for outsourced workers is made
independently based on an initiative between the outsourcing company and the
user company that is set out in writing in an agreement letter in order to
provide legal certainty.
