State Obligations in the Context of Climate Displacement: The Applicability of the Principle of Non Refoulement in the Protection of Environmentally Displaced Persons

Perubahan iklim tidak hanya berdampak pada lingkungan tetapi juga berbagai aspek kehidupan manusia dan kualitasnya. Salah satu dampak signifikan dari perubahan iklim adalah perpindahan individu secara paksa. Namun, pada saat ini, belum ada instrumen hukum internasional yang dirancang khusus untuk melindungi individu yang terdampak oleh perubahan iklim. Penelitian hukum ini bertujuan untuk menganalisis bagaimana prinsip non-refoulement dapat diterapkan untuk mengatasi kekosongan hukum tersebut.

Penelitian hukum ini merupakan penelitian hukum normatif, yang meliputi analisis terhadap norma, kaidah, asas, dan ketentuan hukum, khususnya yang bersifat internasional. Penelitian ini menyimpulkan bahwa prinsip non-refoulement dapat berfungsi sebagai mekanisme perlindungan awal, dan penerapannya akan mengakibatkan kewajiban terhadap negara yang mengharuskan negara untuk mematuhi prinsip tersebut.

Climate change affects not only the environment but also various aspects of human life and its quality. One significant repercussion of climate change is the forced displacement of individuals. However, there are currently no international legal instruments specifically designed to protect these individuals. This legal research aims to analyze how the principle of non-refoulement can be applied to address this gap in the law. 

This legal research utilizes normative legal research, which involves analyzing norms, rules, principles, and legal provisions, particularly those at the international level. The research concludes that the principle of non-refoulement can serve as an initial protection mechanism, and its application would result in state obligations that would require states to adhere to the principle.
