Penerapan Integrated Impact Assessment Framework sebagai Executive Preview Peraturan Daerah Pengelolaan Sumber Daya Air Daerah Istimewa Yogyakarta

Tesis ini mengkaji pembentukan dan hasil evaluasi Perda Pengelolaan Sumber Daya Air di Provinsi DIY dengan penerapan metode IAK. Struktur dari Metode IAK memiliki tiga tahapan dan tujuh pertanyaan analisis yang digunakan untuk menyusun proposal regulasi dan sebagai ex ante review, sehingga penting untuk diterapkan sebagai strategi executive preview Perda.

Metode Penelitian yang digunakan adalah sosio-legal dengan sifatnya deskriptif-preskriptif yang dilengkapi dengan data hasil wawancara dan kumpulan dokumen pembentukan Perda Pengelolaan Sumber Daya Air DIY. Analisis dilakukan dengan pendekatan kualitatif untuk mengkaji penerapan IAK dan proses legislasi Perda dengan penalaran induktif untuk menemukan adanya agree each other.

Hasil penelitian menunjukan bahwa penerapan IAK sebagai metode analisis memiliki signifikansi penting terhadap keberadaan Perda Pengelolaan Sumber Daya Air karena IAK menyederhanakan metode RIA dengan penilaian terintegrasi dengan menekankan pada aspek ex ante dari suatu regulasi atau kebijakan yang akan memberikan perluasan terhadap alternatif-alternatif dalam proses legislasi. Pengujian terintegrasi dan berjenjang dari penerapan IAK dapat menjadi kerangka baru executive preview dengan memperjelas spesifikasi bidang analisis oleh Kemendagri dalam proses fasilitasi dan proses harmonisasi oleh Kanwil Kemenkumham. Sifat futuristik ex ante review memberikan dua jalur evaluasi yaitu analisis yang berbasis bukti dan perkiraan dampak yang paling mungkin terjadi di masa depan. Secara prospektif kerangka yang ditawarkan oleh IAK memiliki koherensi dengan struktur Naskah Akademik serta penekanan analisis dampak yang ditentukan oleh UU 13/2022, sehingga metode IAK bisa menjadi salah satu alternatif alat analisis pembentukan regulasi dan kebijakan di Indonesia.

This Thesis examines the formation and evaluation of the local regulation on water resources management in Yogyakarta special region province by applying the IAK method. The structure of the IAK Method has three stages and seven analysis questions that are used to drafting regulation proposals and as an ex-ante review, so it is important to be applied as a strategy for executive preview of local regulations.

The research method used is socio-legal with a descriptive-prescriptive nature that is complemented by interview data and a collection of documents on the formation of the local regulation on water resources management in Yogyakarta special region. The analysis is conducted using a qualitative approach to examine the application of IAK and the legislative process of the local regulation with inductive reasoning to find the existence of agree each other.

The results show that the application of IAK as an analytical method has important significance to the existence of the Water Resources Management Regional Regulation because IAK simplifies the RIA method with integrated assessment by emphasizing the ex-ante aspects of a regulation or policy that will provide an expansion of alternatives in the legislative process. Integrated and tiered testing from the application of IAK can be a new framework for executive preview by clarifying the specification of the field of analysis by the Ministry of Home Affairs in the facilitation process and the harmonization process by the Regional Office of the Ministry of Law and Human Rights. The futuristic nature of ex-ante review provides two lines of evaluation that is evidence-based analysis and estimation of the most likely impact in the future. Prospectively, the framework offered by IAK has coherence with the structure of the Academic Paper and the emphasis on impact analysis determined by Law 13/2022, so the IAK method can be an alternative tool for analyzing the drafting of laws and regulations and policy in Indonesia.
