POLITIK HUKUM KEPERSERTAAN JAMINAN KESEHATAN NASIONAL DALAM PENDAFTARAN PERALIHAN HAK ATAS TANAH KARENA JUAL BELI

Penelitian ini bertujuan untuk mengetahui dan mengkaji hal yang melatarbelakangi kewajiban kepesertaan Jaminan Kesehatan Nasional (JKN) dalam pendaftaran peralihan Hak Atas Tanah karena Jual Beli. Penelitian ini juga dilakukan untuk mengetahui dan mengkaji penundaan kewajiban kepesertaan Jaminan Kesehatan Nasional dalam pendaftaran peralihan Hak Atas Tanah karena Jual Beli.

Jenis penelitian merupakan penelitian normatif-empiris. Pendekatan pada penelitian ini menggunakan pendekatan perundang-undangan (statute approach) dan pendekatan konseptual (conceptual approach). Penelitian ini merupakan penelitian yang bersifat deskriptif. Metode pengambilan sampel menggunakan jenis purposive sampling dengan Teknik non-probability sampling. Subjek penelitian satu orang Pejabat Pembuat Akta Tanah (PPAT) selaku narasumber. Responden pada penelitian ini Pejabat pada Sekretariat Kabinet Republik Indonesia dan Pejabat pada Kementerian Agraria dan Tata Ruang/Badan Pertanahan Nasional Republik Indonesia. Analisis dalam penelitian ini dilakukan dengan metode kualitatif.

Hasil penelitian menunjukan hal yang melatarbelakangi kewajiban kepesertaan jaminan kesehatan nasional dengan diundangkannya Instruksi Presiden Nomor 1 Tahun 2022 yaitu pertama, Inpres a quo diterbitkan dalam rangka untuk mengoptimalkan program JKN. Kedua, karena kepesertaan program JKN di Indonesia belum mencapai target 98?ri total penduduk Indonesia. Penundaan kewajiban kepesertaan JKN dalam pendaftaran hak atas tanah karena jual beli terjadi karena terdapat beberapa faktor penghambat, yaitu pertama terkait dengan kesiapan sistem yang belum komprehensif. Kedua, masih terdapat kantor pertanahan setempat yang belum di lengkapi dengan stan/loket BPJS Kesehatan beserta petugas. Ketiga, masih banyak pemohon pendaftar tanah yang menunggak iuran JKN.

This study aims to find out and examine the background to the obligation to participate in the National Health Insurance (JKN) in the registration of transfer of land rights due to sale and purchase. This research was also conducted to find out and examine the postponement of National Health Insurance membership obligations in the registration of transfer of land rights due to sale and purchase.

This type of research is normative-empirical research. The approach in this study uses a statutory approach and a conceptual approach. This research is a descriptive research. The sampling method uses purposive sampling with non-probability sampling techniques. The research subject was one Land Deed Making Officer (PPAT) as the resource person. Respondents in this study were officials at the Cabinet Secretariat of the Republic of Indonesia and officials at the Ministry of Agrarian Affairs and Spatial Planning/National Land Agency of the Republic of Indonesia. The analysis in this study was carried out using qualitative methods.

The results of the study show that the background to the obligation to participate in national health insurance with the promulgation of Presidential Instruction Number 1 of 2022 is that first, the a quo Inpres was issued in order to optimize the JKN program. Second, because the participation of the JKN program in Indonesia has not reached the target of 98% of the total population of Indonesia. The postponement of JKN membership obligations in land rights registration was due to the sale and purchase occurring due to several inhibiting factors, namely the first related to the readiness of the system which was not yet comprehensive. Second, there are still local land offices that have not been equipped with BPJS Health booths/counters and officers. Third, there are still many land applicants who are in arrears of JKN contributions.
