Penelitian ini memiliki tujuan untuk menganalisis dan mengetahui mengenai keabsahan akta risalah Rapat Umum Pemegang Saham Elektronik pada perseroan terbuka berbasis aplikasi eASY.KSEI ditinjau dari asas Tabellionis Oficium Fedeliter Exercebo dan asas kecermatan sertra akibat hukum dari akta risalah Rapat Umum Pemegang Saham elektronik perseroan terbuka berbasis aplikasi eASY.KSEI ditinjau dari asas Tabellionis Oficium Fedeliter Exercebo dan asas kecermatan.

Penelitian yang dipergunakan dalam penulisan menggunakan jenis penelitian Yuridis Normatif dan Empiris yaitu suatu pendekatan dengan menggambungkan antara metode penelitian yuridis normatif dengan adanya penambahan berbagai unsur empiris. Penelitian yuridis normatif dan empiris menganalisis implementasi ketentuan hukum normatif dalam praktiknya pada setiap peristiwa hukum yang terjadi.

Berdasarkan penelitian dapat disimpulkan bahwa Keabsahan akta Rapat Umum Pemegang Saham Luar Biasa secara elektronik berbasis aplikasi eASY.KSEI ditinjau dari asas kecermatan dan asas Tabellionis Oficium Fedeliter Exercebo, adalah tidak sah apabila dilihat berdasarkan ketentuan asas kecermatan dan ketentuan dari asas Tabellionis Oficium Fedeliter Exercebo. Akibat hukum dari tidak sahnya akta berbasis aplikasi eASY.KSEI ditinjau dari asas kecermatan dan asas Tabellionis Oficium Fedeliter Exercebo, apabila aspek formil dari akta yang dilanggar maka akta tersebut dapat menjadi objek gugatan namun tetap mengikat para pihak, apabila aspek materiilnya dilanggar maka akta tersebut tidak mempunyai kekuatan eksekutorial dan batal demi hukum dengan putusan pengadilan. apabila tidak ada tindakan pembatalan dari para pihak , maka kontrak tetap berlaku dan mengikat bagi para pihak.

This research aims to analyze and determine the validity of the deed of minutes of the Electronic General Meeting of Shareholders in the eASY.KSEI application-based public company in terms of the principles of Tabellionis Oficium Fedeliter Exercebo and the principle of accuracy and legal consequences of the deed of minutes of the electronic General Meeting of Shareholders of an application-based public company eASY.KSEI is reviewed from the principles of Tabellionis Oficium Fedeliter Exercebo and the principle of accuracy.

The research used in writing uses Normative and Empirical Juridical research, namely an approach that combines normative juridical research methods with the addition of various empirical elements. Normative and empirical juridical research analyzes the implementation of normative legal provisions in practice in every legal event that occurs.

Based on the research, it can be concluded that the validity of the deed of the electronic Extraordinary General Meeting of Shareholders based on the eASY.KSEI application, viewed from the principle of accuracy and the principle of Tabellionis Oficium Fedeliter Exercebo, is invalid if viewed based on the provisions of the principle of accuracy and the provisions of the principle of Tabellionis Oficium Fedeliter Exercebo. The legal consequences of the invalidity of a deed based on the eASY.KSEI application are viewed from the principle of accuracy and the principle of Tabellionis Oficium Fedeliter Exercebo, if the formal aspects of the deed are violated then the deed can become the object of a lawsuit but it is still binding on the parties, if the material aspects are violated then the deed is not has executorial power and is null and void with a court decision. If there is no cancellation action from the parties, then the contract remains valid and binding on the parties.
