Tinjauan Terhadap Penerbitan Izin Pertambangan pada Kawasan Ekosistem Leuser (Studi Kasus di Kecamatan Beutong Ateuh Banggalang, Kabupaten Nagan Raya, Provinsi Aceh)

Penelitian ini bertujuan untuk menganalisis landasan hukum penerbitan pemberlakuan Izin Usaha Pertambangan Operasi Produksi Mineral Logam Nomor 66/I/IUP/PMA/2017, mengetahui landasan hukum yang mengatur perlindungan bagi Kawasan Ekosistem Leuser terhadap pertambangan ilegal di Indonesia serta potensi dampak yang mungkin timbul dan terbukti nyata timbul sejak pemberlakuan Izin Usaha Pertambangan Operasi Produksi Mineral Logam Nomor 66/I/IUP/PMA/2017 kepada PT. Emas Mineral Murni yang berada dalam Kawasan Ekosistem Leuser (KEL).
Penelitian hukum ini adalah penelitian hukum yuridis normatif dengan pendekatan perundang-undangan (Statue Approach) yang menggunakan bahan hukum primer dan bahan hukum sekunder untuk mengkaji isu hukum mengenai kualifikasi penerbitan Izin Usaha Pertambangan di Kawasan Ekosistem Leuser serta masalah dalam pemberlakuan Izin Usaha Pertambangan Operasi Produksi Mineral Logam Nomor 66/I/IUP/PMA/2017 ditinjau dalam peraturan perundang-undangan di Indonesia. Teknik pengumpulan bahan hukum sekunder dalam penulisan ini menggunakan teknik studi kepustakaan (library research). Bahan hukum lainnya didapatkan dalam wawancara narasumber. Data yang diperoleh kemudian dikaji menggunakan metode kualitatif yang dijabarkan secara deskriptif.
Hasil penelitian ini menunjukkan: Pertama, Penerbitan SK IUP 2017 yang dilakukan oleh BKPM tidak memenuhi syarat materiil (Bevoegd) atau keputusan dikeluarkan oleh Badan atau Pejabat yang tidak berwenang atasnya. WIUP berada dalam KEL yang berdasarkan UU Pemerintah Aceh kewenangan regulasinya berada sepenuhnya pada Gubernur, Bupati, dan/atau Walikota Aceh. Kedua, Pengelolaan KEL sempat mengalami dualisme yakni oleh Yayasan Leuser Internasional (YLI) berdasarkan Keputusan Presiden Nomor 33 Tahun 1998 dan oleh Badan Pengelola Kawasan Ekosistem Leuser (BPKEL) melalui Peraturan Gubernur Nomor 52 Tahun 2006. Saat ini, tidak ada pendelegasian wewenang kepada lembaga atau badan negara apapun.
This research aims to analyze the legal basis for the Mining License for Production of Metal Minerals Number 66/I/IUP/PMA/2017 and review the legal basis of government protection for the Leuser Ecosystem Area against illegal mining in Indonesia. Furthermore, the research seeks to discover potential impacts that may arise and be proven to have occurred since the issuance of the Mining License for Production of Metal Minerals Number 66/I/IUP/PMA/2017 to PT. Emas Mineral Murni in the Leuser Ecosystem Area (KEL).
The type of research used in this legal writing is normative juridical research with a statutory approach that uses primary legal materials and secondary legal materials to examine legal issues regarding the qualifications for issuing Mining Business Permits in the Leuser Ecosystem Area and problems in the application of Mining Business Permits Metal Mineral Production Operation Number 66/I/IUP/PMA/2017 reviewed in the laws and regulations in Indonesia. The technique of collecting secondary legal materials in this writing uses library research techniques. Other legal materials were obtained from interviews with informants. The data obtained were then examined using qualitative methods described descriptively.
The results of this study indicate: First, the issuance of SK IUP 2017 carried out by BKPM does not meet the material requirements (Bevoegd), or decisions are issued by bodies or officials who are not authorized thereto. WIUP is within the KEL, based on the Law of the Government of Aceh; the regulatory authority lies entirely with the Governor, Regent, and/or Mayor of Aceh. Second, the management of KEL had experienced dualism, namely by the Leuser International Foundation (YLI) based on Presidential Decree Number 33 of 1998 and by the Leuser Ecosystem Area Management Agency (BPKEL) through Governor Regulation Number 52 of 2006. However, currently, there is no delegation of authority to the agency or any state agency.
