The purpose of this legal writing is to understand and analyze the legal protection for consumers regarding the use of doctor-prescribed cosmetic products circulating in Yogyakarta by examining the role of BBPOM Yogyakarta in suppressing the circulation of freely distributed doctor-prescribed cosmetic products in order to protect consumers, as well as the responsibility of businesses that produce and distribute these doctor-prescribed cosmetic products when consumers are harmed.
This legal writing is a juridical-empirical research conducted in a descriptive manner through literature review by reading and analyzing primary, secondary, and tertiary legal materials related to this research. It also involves field studies through interviews and questionnaires filled out by respondents related to the subject. The collected data is analyzed using qualitative methods.
The research findings indicate that: First, the role of BBPOM Yogyakarta in suppressing the distribution of freely distributed doctor-prescribed cosmetic products is carried out through various means in accordance with the provisions of BPOM Regulation No. 24/2021. This includes monitoring and suppressing the circulation of doctor-prescribed cosmetic products, as well as overseeing the management of Medicines, Medicinal Ingredients, Narcotics, Psychotropics, and Pharmaceutical Precursors. BBPOM Yogyakarta conducts monitoring, provides technical guidance, and offers guidance for offline and online pharmaceutical service facilities. However, the role played by BBPOM Yogyakarta is not yet optimal, resulting in a lack of preventive and repressive legal protection for consumers. Second, regarding the accountability of doctor-prescribed cosmetic product businesses, there are various efforts made, including providing compensation and indemnification according to mutually agreed terms between the businesses and consumers. Additionally, the businesses may also provide compensation in the form of other products that can resolve the consumers' issues.
