Perubahan Hukum Adat yang Mengatur Pemanfaatan Hutan Adat di Kabupaten Kampar sebagai Hukum yang Hidup dalam Masyarakat

Hutan adat merupakan sumber daya alam yang dimiliki masyarakat hukum adat di Kabupaten Kampar. Hutan Adat dimanfaatkan berdasarkan hukum  adat yang berlaku. Hukum adat dalam pemanfaatan hutan adat telah mengalami perubahan. oleh sebab itu penelitian ini memusatkan kajian pada tiga hal utama. Pertama, meneliti tentang perubahan hukum adat yang mengatur pemanfaatan hutan adat di Kabupaten Kampar. Kedua, meneliti faktor yang mempengaruhi perubahan hukum adat yang mengatur pemanfaatan hutan adat di Kabupaten Kampar. Ketiga, meneliti eksistensi hukum adat saat ini dalam mengatur pemanfaatan hutan adat apabila dikaitkan dengan peraturan perundang-undangan yang berlaku.

jenis penelitian yang digunakan dalam penelitian disertasi ini adalah socio-legal research. Lokasi penelitian ini di Kabupaten Kampar khususnya di Hutan Adat Ghimbo Bonca Lida dan Ghimbo Pomuan Kenegerian Kampa serta Hutan Adat Imbo Putui Kenegerian Petapahan. Pengumpulan data melalui studi pustaka dan penelitian lapangan. Data dianalisis secara kualitatif dengan memadukan data primer dan data sekunder. Permasalahan penelitian dijawab dengan teori living law dan sistem sosial.

Hasil penelitian menunjukkan bahwa perubahan hukum adat dalam pemanfaatan hutan adat sebagai hukum yang hidup dalam masyarakat terjadi pada aspek nilai, asas, norma dan perilaku yang mengatur pemanfaatan hutan adat, aspek pembagian kawasan hutan, aspek kelembagaan pengawasan dan perubahan aspek sanksi adat. Kedua, terjadinya perubahan hukum adat yang mengatur pemanfaatan hutan adat di Kabupaten Kampar sebagai hukum yang hidup dalam masyarakat disebabkan oleh faktor-faktor yang mempengaruhi perubahan hukum adat baik dari faktor internal masyarakat hukum adat berupa kesadaran hukum dan perkembangan masyarakat hukum adat, maupun faktor eksternal berupa faktor ekonomi, sosial, budaya, politik, ilmu pengetahuan dan teknologi serta faktor globalisasi. Ketiga, Eksistensi Hukum adat yang mengatur pemanfaatan hutan adat saat ini semakin mendapatkan kepastian dan penguatan ditinjau dari peraturan perundang-undangan yang berlaku.

Customary forest is one of the natural resources owned by adat law communities in Kampar Regency. The Utilization of Customary Forest is based on adat law of the communities. The law has changed. This research focuses on three main points. First, researching the changes of adat law in the use of customary forests in Kampar Regency. Second, researcing the reason for the changes of adat law in the use of customary forests in Kampar Regency as a living law of the community. Third, the researcing the current existence of adat law in use of customary forests when linked to the applicable laws and regulations.

The research used in this dissertation is socio-legal research. The location of the research is in Kampar Regency, especially in Ghimbo Bonca Lida and Ghimbo Pomuan Kenegerian Kampa Customary forests and Imbo Putui Kenegerian Petapahan Customary Forest. Data Collection through literature study and field research. Data were analyzed qualitatively by combining primary data and secondary data. Research problems are answered by using living law theory and social system.

The results of the study show that first, changes of adat law in the use of customary forests as living laws in society occur in aspects of values, principles, norms and behaviors in the use of customary forests, Aspects of forest area division, aspects of institutional supervision, and aspects of customary sanctions. The changes of adat law are dynamic following development of adat law communities in Kampar Regency. Second, Changes of adat law in the use of customary forests in Kampar Regency as living laws of community are caused by factors that influence changes in adat law, both from internal factors in the form of legal awarenees and the development of adat law communities, as well as external factors in form of economic, social, cultural, political, science and technology as well as glabalization. Third, the existance of adat law in the use of customary forest in currently getting more certainty and strengthening in terms of the aplicable laws and regulations.
