IMPLIKASI HUKUM DALAM PENERBITAN DAN PENYELESAIAN WARKAT BILYET GIRO KOSONG (STUDI KASUS DI BANK MANDIRI CABANG RASUNA EPICENTRUM)

TTujuan dari penelitian ini untuk menganalisis serta mengetahui implikasi hukum mengenai penerbitan warkat bilyet giro kosong dan untuk mengetahui penyelesaian masalah warkat bilyet giro kosong di Bank Mandiri Cabang Jakarta Rasuna Epicentrum.
Penulisan tesis ini menggunakan jenis penelitian yaitu metode penelitian menggunakan penelitian hukum normatif empiris. Penelitian hukum normatif empiris berupa perilaku hukum dengan pelaksanaan ketentuan hukum positif pada peristiwa hukum tertentu yang terjadi di masyarakat. Implementasi merupakan pokok kajiannya. Analisis secara kualitatif berbentuk penafsiran atas data-data dari studi kepustakaan yang memiliki tujuan menemukan solusi dari permasalahan yang ada dalam penelitian.
Penelitian ini menghasilkan temuan, yaitu implikasi hukum atas penerbitan warkat bilyet giro kosong di Bank Mandiri Cabang Jakarta Rasuna Epicentrum terhadap penerbit ialah sanksi secara administratif, berbentuk pencantuman namanya dalam daftar hitam dikenakan sekurang-kurangnya selama enam bulan terhitung sejak tanggal penutupan rekening giro serta penutupan rekening penerbit. Bentuk dari proses menyelesaikan masalah dari warkat bilyet giro kosong di Bank Mandiri Cabang Jakarta Rasuna Epicentrum, yakni pada waktu dilaksanakan sanksi administratif tersebut ternyata penarikan warkat bilyet giro dilakukan oleh yang bersangkutan serta adanya penolakan kembali terjadi, mengakibatkan sanksi yang diberikan akan diperpanjang selama 6 (enam bulan) dimulai pada saat penolakan warkat bilyet giro terakhir ditetapkan tanggalnya. Kemudian nasabah yang menerbitkan untuk keduakalinya masuk kedalam daftar hitam, berakibat kepada jangka waktu sanksi administratif ditambah minimal 12 (dua belas) bulan serta pencantuman masa sanksinya ditetapkan minimal selama 24 (dua puluh empat) bulan. Bank Indonesia akan menghapus daftar hitam selama dua tahun sejak tanggal ditetapkan.

Qualitative analysis in the form of interpretation of the data that has been inventoried from the literature study which has the aim of finding solutions to the problems that exist in research.
The research resulted that the consequence for withdrawing of blank bilyet giro certificate is the imposition of administrative sanctions the administrative sanction period for closing the Withdrawer's account and including his name on the black list is imposed for at least six months from the date of closing of the current account. If during the period of imposition of the administrative sanction it turns out that the person concerned returns to withdrawing the giro slip and there is another rejection, then the sanction will be extended for another 6 (six months) commencing from the date of rejection of the last giro slip. If an issuer customer is included in the black list for the second time, the administrative penalty period is determined to be at least 12 (twelve) months and the inclusion of the penalty period is set to be at least 24 (twentyfour) months. Fourth, the black list which is valid for two years after issuance will be removed by Bank Indonesia.
