Perlindungan Hukum Bagi Konsumen Minuman Berpemanis dalam Kemasan (MBDK) yang Berpotensi Meningkatkan Prevalensi PTM: Diabetes Melitus di Daerah Istimewa Yogyakarta (DIY)

This legal research aims to find out and examine the legal protection for SSBs consumption which potentially increase the prevalence of noncommunicable disease: diabetes melitus in DIY. This research also aims to examine the role of the related stakeholders on decreasing the prevalence of noncommunicable diseases, particularly diabetes melitus related to sugar sweetened beverages (SSBs) consumption, in DIY.
This legal research is a normative-empirical and analytical-descriptive research. This research conducted literature review with primary, secondary and tertiary legal resources. Field research was conducted using in-depth interviews with opened interview guidelines and also conducted an online survey using Google Form shared on social media. Collected data was analyzed descriptively.
Based on the result of this legal research, this study concluded that: first, legal protection for SSBs consumption is not yet being regulated under current law. In the recent situation, preventive and repressive legal protection for SSBs consumption just refers to the refined food regulations implicitly. However, the legal protection for SSBs consumers is not required from the basic principle of the legal protection regulator. The regulation of SSBs is the government obligation to exist based on the Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 and Undang-Undang Nomor 36 Tahun 1999 tentang Kesehatan. Second, the effort to decrease the noncommunicable diseases prevalence, particularly diabetes melitus, is not yet optimum, especially in DIY. The government’s effort to decrease the diabetes melitus prevalence in DIY could be seen through Gerakan Masyarakat (GERMAS) “Gendhis Manis” and “CERDIK”. Finally, the present study underlined that significant and forceful regulation regarding SSBs consumption is needed.
