FAKTOR-FAKTOR BESERTA DAMPAK HUKUM TERHADAP PELINDUNGAN INVESTASI DARI PENERAPAN PASAL 5 ILC ARTICLES ON RESPONSIBILITY OF STATE FOR INTERNATIONALLY WRONGFUL ACTS UNTUK ATRIBUSI TINDAKAN PERUSAHAAN MILIK NEGARA DI BAWAH ARBITRASE INVESTASI INTERNASIONAL

Penelitian ini bertujuan untuk mengetahui faktor-faktor yang dipertimbangkan tribunal investasi internasional dalam menyelesaikan permasalahan atribusi berdasarkan Pasal 5 ILC Articles on Responsibility of State for Internationally Wrongful Acts beserta dampak hukumnya terhadap sengketa investasi yang sedang berlangsung. Penelitian ini melihat pengaturan Tribunals dalam beberapa kasus arbitrase investasi internasional yaitu Flemingo v. Poland, Gustav v. Ghana, CSOB v. Slovakia, dan BUCG v. Yemen. Metode penelitian yang digunakan dalam penelitian ini adalah metode yuridis- normatif dengan pendekatan kualitatif. Penelitian ini menggunakan pendekatan comparative case-study dengan menggunakan pendekatan perbandingan kasus- kasus. Bahan hukum primer yang digunakan berupa ARSIWA. Adapun bahan hukum sekunder adalah berupa putusan-putusan kasus sengketa investasi internasional oleh tribunal arbitrase investasi internasional, buku-buku, artikel, jurnal, hasil penelitian, dan bentuk-bentuk lainnya. Berdasarkan hasil pembahasan yang telah dilakukan penulis, maka penelitian ini menghasilkan kesimpulan berupa: Pertama faktor-faktor yang diperhatikan tribunal dalam menganalisis Pasal 5 ARSIWA adalah adanya instrumen hukum yang dibuat oleh negara asal sebuah perusahaan milik negara, jenis kegiatan yang dimiliki perusahaan tersebut dalam sengketa tersebut, dan kapasitas perusahaan milik negara dalam melaksanakan tindakan yang dipersoalkan dalam investasinya. Kedua, persoalan atribusi yang dibawa dan diterima pada tahap yurisdiksi akan membawa dampak hukum berupa berubahnya personalitas hukum salah satu pihak, sehingga menghilangkan yurisdiksi tribunal dan pada tahap merits akan membawa dampak hukum berupa diakui adanya tindakan negara di bawah hukum internasional. This study aims to understand the factors considered by the international investment tribunals in solving attribution issues in accordance with Article 5 ARSIWA and its legal consequences towards the existing investment. This study observes the decision of the Tribunals in several international investment arbitration cases, such as Flemingo v. Poland, Gustav v. Ghana, CSOB v. Slovakia, dan BUCG v. Yemen. The research method used in this study is a normative-juridical method with a qualitative approach. This study uses a comparative case-study approach using a case-by-case comparison approach. The primary legal material used is ARSIWA. The secondary legal materials are in the form of decisions on international investment dispute cases by international investment arbitration tribunals, books, articles, journals, research results, and other forms. Based on the result of the discussion done by author, the result of the study are: First, the factors considered by the Tribunals om analyzing Article 5 ARSIWA are the existence of legal instruments made by the home state of the state-owned enterprise, the type of activities possessed by the enterprise in the specific context of the disputed even, and the state-owned enterprise's capacity in carrying out the disputed acts in its investment. Second, the issue of attribution that is brought and accepted at the jurisdictional stage will have a legal impact in the form of a change in the legal personality of one of the parties, thereby eliminating the jurisdiction of the tribunal and the issue of attribution that is brought and accepted at the merits stage will have a legal impact in the form of the recognition of state actions under international law.
