Pengalihan Hak Cipta atas Ciptaan dalam Perlombaan Batik Kontemporer Khas Daerah dengan Ketentuan Seluruh Karya Menjadi Milik Panitia Berdasarkan UU Nomor 28 Tahun 2014 tentang Hak Cipta

Penelitian ini bertujuan untuk mengetahui kedudukan peserta dan panitia terkait kepemilikan hak cipta atas ciptaan dalam perlombaan batik kontemporer khas daerah dengan ketentuan seluruh karya menjadi milik panitia (SKMMP). Penelitian ini juga bermaksud untuk melihat legalitas serta konsekuensi hukum dari ketentuan SKMMP yang dijadikan sebagai dasar pengalihan hak cipta dalam perlombaan. Penelitian ini merupakan penelitian yuridis normatif. Data sekunder dianalisis secara kualitatif dengan pendekatan analitis, perundang-undangan, dan konsep. Hasil penelitian ini menunjukkan bahwa peserta berkedudukan sebagai pencipta dan panitia dapat berkedudukan sebagai pemegang hak cipta sepanjang dilakukan pengalihan hak cipta yang sah. Pengalihan hak cipta yang hanya dilakukan berdasarkan ketentuan SKMMP yang ada dalam pengumuman perlombaan adalah tidak sah karena pengalihan hak cipta harus tertulis. Pengalihan hak cipta yang didasarkan pada ketentuan SKMMP berbentuk klausul kesediaan peserta untuk mengalihkan hak atas karya kepada panitia dalam dokumen perlombaan, dianggap sah dan sesuai dengan Pasal 16 ayat (2) huruf e UUHC 2014 jika menyebut dengan jelas bahwa yang akan dialihkan hanyalah hak ekonomi. Apabila tidak disebut secara jelas, ketentuan SKMMP menjadi obscuur karena dimungkinkan untuk terjadi pengalihan hak moral yang bertentangan dengan UUHC 2014, sehingga dokumen tersebut batal demi hukum dan pengalihan hak cipta tersebut menjadi tidak sah. Adapun konsekuensi hukum yang timbul dari pengalihan hak cipta yang tidak sah berdasarkan Pasal 17 ayat (2) UUHC 2014 adalah hak ekonomi tidak beralih kepada panitia tetapi tetap berada di tangan peserta lomba selaku pencipta.

This study aims to determine the legal standing of the contestant and the committee related to the ownership of copyright for the works in a regional typical contemporary batik contest with provision that all works belong to the committee (AWBTC). Furthermore, this study aims to determine the AWBTC provision and the legal consequence that will arise from the transfer of copyright based on the AWBTC provision. This research is normative juridical research. The secondary data were analyzed qualitatively with an analytical approach, legislation, and concepts. This results of this study indicate that the contestant has legal standing as the author and the committee has legal standing as the copyright holder as long as there has been a legitimate transfer of copyright. The transfer of copyright, which is only conducted based on the existence of AWBTC provision in the contest's announcement, is not legitimate because the transfer of copyright must be conducted in writing. The transfer of copyright, which is conducted based on the AWBTC provision in the form of the contestant's willingness clause in the contest's document, is legitimate and in accordance with Article 16 paragraph (2) point b of the Indonesian Copyright Law Number 28 of 2014, if it is clearly stated that only economic rights will be transferred. If it is not clearly stated in the document, the AWBTC provision becomes obscure because there is a possibility of transferring moral rights, which is contrary to Indonesian Copyright Law Number 28 of 2014. Therefore, the document is null and void and the copyright transfer becomes not legitimate. Further, the legal consequence arising from the illegitimate transfer of copyright based on Article 17 paragraph (2) of the Indonesian Copyright Law Number 28 of 2014, is that economic rights do not transfer to the committee or the economic rights are still owned by the contestant as the author.
