SEJARAH PENGUASAAN DAN KONFLIK PENGUASAAN TANAH DALAM KAWASAN HUTAN AFGESCHREVEN DJATIBOSCH DI KABUPATEN GUNUNGKIDUL DAERAH ISTIMEWA YOGYAKARTA

Penulisan hukum ini ditujukan untuk menganalisis beberapa hal. Pertama, untuk menganalisis status kawasan hutan AB yang menjadi sumber konflik penguasaan antara Kementerian Lingkungan Hidup dan Kehutanan dengan Kasultanan Yogyakarta. Kedua, untuk menganalisis upaya penyelesaian penguasaan tanah yang dilakukan oleh masyarakat dalam kawasan hutan AB. Penelitian ini bersifat deskriptif dengan jenis penelitian hukum normatif. Untuk mendapatkan informasi tambahan, penulis melakukan wawancara dengan narasumber. Jenis data yang digunakan dalam penelitian ini adalah data sekunder yang kemudian dianalisis secara deskriptif untuk mendapatkan hasil penelitian. Terdapat dua kesimpulan yang didapatkan dari penelitian hukum ini. Pertama, berdasarkan sejarahnya, diketahui bahwa beberapa entitas yang secara berturut-turut menguasai kawasan hutan AB yaitu Kasultanan Yogyakarta, Pemerintah Inggris, Pemerintah Hindia Belanda, dan Kasultanan Yogyakarta. Kedua, terkait status kawasan hutan AB dan upaya penyelesaian permasalahan penguasaan tanah dalam kawasan hutan AB yang dilakukan oleh masyarakat, berdasarkan hasil penelitian diketahui bahwa status kawasan hutan AB merupakan hutan yang termasuk kawasan hutan negara, selanjutnya diketahui bahwa upaya penyelesaian yang sesuai bagi masyarakat yaitu adanya mekanisme pelepasan kawasan hutan atau persetujuan penggunaan kawasan hutan serta mekanisme kebijakan perhutanan sosial.

This legal writing is intended to analyze several things. First, to analyze the status of the AB forest area which is a source of tenure conflicts between the Ministry of Environment and Forestry and the Sultanate of Yogyakarta. Second, to analyze efforts to settle land tenure by the community in the AB forest area. This research is descriptive with the type of normative legal research. To obtain additional information, the authors conducted interviews with the informants. The type of data used in this research is secondary data which is then analyzed descriptively to get the results of the research. There are two conclusions obtained from this legal research. First, based on history, it is known that several entities controlled the AB forest area successively, namely the Yogyakarta Sultanate, the British Government, the Dutch East Indies Government, and the Yogyakarta Sultanate. Second, related to the status of the AB forest area and efforts to resolve land tenure issues in the AB forest area carried out by the community, based on research results it is known that the status of the AB forest area is a forest included in the state forest area, furthermore it is known that the appropriate settlement efforts for the community are mechanism for releasing forest area or approval for use of forest area as well as social forestry policy mechanism.
