KEPASTIAN HUKUM BAGI PEMOHON PENDAFTARAN HAK ATAS TANAH EKS KAWASAN HUTAN GEDONG WANI REGISTER 40 DI KABUPATEN LAMPUNG TIMUR

Penelitian ini bertujuan untuk mengetahui dan menganalisis tentang status kawasan hutan Gedong Wani Register 40 secara yuridis dan pemberian kepastian hukum atas pendaftaran hak atas tanah eks Kawasan Hutan Gedong Wani Register 40 di Kabupaten Lampung Timur. Penelitian ini termasuk dalam jenis penelitian normatif-empiris yaitu penelitian hukum yang objek kajiannya meliputi ketentuan perundang-undangan (in abstracto) serta penerapannya pada peristiwa hukum (in concreto). Pada penelitian hukum Normatif, menggunakan sumber-sumber data sekunder, yaitu peraturan perundang-undangan, teori hukum dan pendapat para sarjana terkemuka. Sedangkan penelitian hukum empiris menggunakan data yang Penulis peroleh melalui penelitian lapangan. Adapun sifat penelitiannya adalah penilitian deskriptif. Hasil penelitian ini adalah status Kawasan Hutan Gedong Wani Register 40 di Sindang Anom merupakan eks Kawasan hutan yang diajukan pelepasan dan berada diluar penetapan kawasan hutan Provinsi Lampung pada tahun 2000. Namun, adanya pelepasan tersebut tidak serta-merta bidang-bidang tanah dapat dijadikan hak milik, melainkan penguasa fisik atas tanah harus mengajukan permohonan melalui Kepala Kantor Pertanahan di kabupaten setempat. Berdasarkan data lapangan yang Penulis peroleh sebanyak 100% dari sampel penelitian ini proses pendaftaran hak atas tanahnya tidak dapat diproses karena yang bersangkutan tidak dapat menunjukkan berkas secara lengkap. Kesimpulan pada penilitian ini adalah tanah yang telah dilakukan pendaftaran tanah dan penerbitan sertipikat tidak diajukan gugatan, namun terhadap bidang tanah yang belum didaftarkan maka pendaftaran tersebut sudah tidak dapat dilakukan. Sedangkan pemberian kepastian hukum terhadap pendaftaran hak atas tanah eks Kawasan Hutan Gedong Wani Register 40 hanya diberikan kepada Pemohon yang telah membayar biaya alih fungsi.

This study aims to find out and analyze the legal status of the Gedong Wani Register 40 forest area and provide legal certainty for the registration of land rights in the former Gedong Wani Register 40 Forest Area in East Lampung Regency. This research is included in the type of normative-empirical research, namely legal research whose object of study includes statutory provisions (in abstracto) and their application to legal events (in concreto). In normative legal research, secondary data sources are used, namely laws and regulations, legal theory and opinions of leading scholars. Meanwhile, empirical legal research uses data that the author obtained through field research. The nature of the research is descriptive research. The results of this study are that the status of the Gedong Wani Forest Area Register 40 in Sindang Anom is a former forest area that was proposed for relinquishment and was outside the designation of a forest area in Lampung Province in 2000. However, this release does not necessarily mean that land parcels can be made property rights , but the physical owner of the land must submit an application through the Head of the Land Office in the local district. Based on the field data that the author obtained as much as 100% of the research sample, the land rights registration process could not be processed because the person concerned could not show the complete files. The conclusion of this research is that land registration has been carried out and certificate issuance has not been filed with a lawsuit, but for land parcels that have not been registered, such registration cannot be carried out. Meanwhile, the provision of legal certainty regarding the registration of land rights in the former Gedong Wani Forest Area Register 40 was only granted to the Petitioner who had paid the transfer fee.
