Penelitian ini bertujuan untuk mengetahui dan menganalisis pemberian pelindungan hukum kepada investor emas fisik melalui Lembaga Kliring Berjangka dan Bursa Berjangka, serta mengetahui dan menganalisis pelaksanaan Pelindungan hukum berupa mitigasi risiko oleh Badan Pengawas Berjangka Komoditi bagi investor terkait emas fisik. Penelitian ini mempergunakan metode penelitian hukum normatif yang mengkaji pemrosesan bagaimana hukum itu diterapkan, sehingga kepentingan berupa pelindungan hukum yang merupakan hak bagi investor terpenuhi dengan deskripsi mitigasi risiko hukum sesuai ketentuan perundang-undangan yang berlaku. Hasil penelitian dan pembahasan dari tesis ini adalah pemberian pelindungan hukum bagi investor emas fisik telah diberikan di dalam sistem perdagangan berjangka komoditi, namun belum secara menyeluruh dikaitkan dengan penanggulangan dan pencegahan komoditi emas yang kondisinya ketika disimpan hilang dalam depository, dan pelaksanaan pelindungan hukum bagi investor dapat membuahkan hasil yang menjamin kondisi keuangan investor dan kepentingan investor terpenuhi jikalau transaksi aman, pelayanan penyepadanan harga yang transparan, kepatuhan Lembaga Kliring Berjangka dan Bursa Berjangka terpenuhi, birokrasi pemerintahan yang melayani masyarakat dengan sasaran yang terarah dalam jangka waktu tertentu, serta persamaan di depan hukum tanpa memandang investor sebagai pihak yang lemah.

This study aims to identify and analyze the provision of legal protection to physical gold investors through the Futures Clearing House and Futures Exchange, as well as to identify and analyze the implementation of legal protection in the form of risk mitigation carried by the Commodity Futures Supervisory Agency for investors related to physical gold. This study uses a normative legal research method that examines the processing of how the law is applied, so that interests in the form of legal protection which are rights for investors are fulfilled with applicable laws and regulations. The results of the study and discussion of this thesis are that the provision of legal protection for physical gold investors has been provided in the commodity futures trading system, but has not been completely linked to the tackling and prevention of gold commodities which condition when stored in depository is lost, and the implementation of legal protection for investors can produce results that guarantee the financial conditions of investors are fulfilled if transactions are secured, price matching services are transparent, the compliance of Futures Clearing House and Futures Exchange is met, bereaucracy of government that serves the societies with achievable targets within a certain period of time, and equality before the law without seeing investors as a weak party.
