IMPLEMENTASI TERHADAP HASIL RAPAT PLENO PENGURUS PUSAT YANG DIPERLUAS DI BALIKPAPAN 12 JANUARI 2017 TENTANG BATAS MINIMAL HONORARIUM NOTARIS DI KABUPATEN KLATEN

Penelitian ini bertujuan untuk mengetahui implementasi besaran batas Minimal Honorarium yang dapat diterima Notaris terkait hasil RP3YD di Balikpapan oleh Pengurus Daerah INI Kabupaten Klaten. Tujuan selanjutnya untuk mengetahui upaya yang dilakukan INI Kabupaten Klaten untuk meminimalisasi pelanggaran terkait dengan ketentuan batas Minimal Honorarium yang dilakukan oleh Notaris di Kabupaten Klaten. Penelitian ini merupakan jenis penelitian normatif empiris yang bersifat deskriptif. Penelitian normatif menggunakan data sekunder dari bahan pustaka yaitu bahan hukum primer, sekunder dan tersier, sedangkan penelitian empiris menggunakan data primer dari wawancara dengan responden dan narasumber dilapangan yang menggunakan alat pedoman wawancara. Data hasil penelitian diklasifikasi menjadi data kualitatif yang disajikan secara deskriptif. Berdasarkan hasil rumusan masalah, pertama disimpulkan bahwa implementasi batas Minimal Honorarium berdasarkan hasil RP3YD dikembalikan ke Pengurus Daerah masing-masing belum terimplementasikan secara baik karena sifatnya tidak memaksa anggotanya. Hasil RP3YD terkait Honorarium disampaikan melalui rapat yang diadakan Pengurus Daerah INI Kabupaten Klaten berupa ketentuan kesepakatan bersama. Kedua, upaya yang dilakukan INI Kabupaten Klaten untuk meminimalisasi pelanggaran ketentuan batas Minimal Honorarium Notaris dengan melakukan upaya preventif pendekatan persuasif. Pendekatan persuasif lebih ke tindakan ajakan rekan Notaris untuk tetap mematuhi peraturan apabila masih dilanggar maka dapat dijatuhi sanksi sesuai Pasal 6 Kode Etik Notaris.

The purpose of this Legal Research is to find out the implementation of minimum amount of honorarium that can be accepted by a Notary according to the outcomes of RP3YD in Balikpapan by Regional Regulator of Indonesian Notary Organization in Klaten District. Secondly, the aim of this research is to knowing the effort that can be done by Indonesian Notary Organization of Kltaten district of honorarium Notary member in Klaten. This research is a normative empirical research that will be explained descriptively, where normative research uses secondary data of library research or theoretical references such as primer, secondary, and primary data. While the empirical research is conducted by interviewing the respondent and informant to acquire data regarding minimum honorarium for Notary. The result of this research is classified as qualitative and presented descriptively. The result of the first research question of this thesis can be concluded that the minimum limit of honorarium in accordance to RP3YD that returned back to each regional regulator is not well implemented because its regulation is not meant to be applied coercively. The conclusion of RP3YD in regards to honorarium is delivered through a meeting conducted by the Regional Regulator of Indonesian Notary Organization of Klaten district which resulting an agreement. Secondly, the action that has been taken by Indonesian Notary Organization of Klaten district to minimize the violation of honorarium limit towards notary by conducting a preventive action through persuasive approach. The persuasive approach is a solicitation action for notary members to make them obey the regulation, as if the notary still violating the regulation they will be punished as it is stated on Article 6 of the Code of Notary Ethics.
