In the Name of Post-Pandemic Recovery: The Omnibus Law and Its Impacts on Democracy and the Reorganisation of the Oligarchs in Indonesia

Pengesahan UU Cipta Kerja pada masa pandemi telah melanggar pasal 28F, sehingga menimbulkan pelanggaran terhadap demokrasi. Terlebih lagi, unit perancang undang-undang, parlemen, hingga menteri-menteri yang terlibat didalam proses perancangan UU Cipta Kerja memiliki hubungan langsung maupun tidak langsung di dalam industri pertambangan. Fenomena ini memungkinkan kelompok oligarki pada pemerintahan Jokowi untuk mendapatkan banyak keuntungan melalui UU tersebut. Penelitian ini bermaksud untuk mencari sebab akibat dari UU Cipta Kerja terhadap kondisi politik demokrasi di Indonesia, menganalisa pembuka jalur yang memungkinkan sebuah restrukturisasi terhadap kelompok oligarki di Indonesia.

The enacted mechanism of Omnibus Law during the Covid-19 pandemic offends Article 28F of the Indonesian Constitution, thereby constituting a democracy violation. Furthermore, the Omnibus Law planning commission, task committee, leadership of the Indonesian Parliament, and several related ministries have direct and indirect ties to Indonesia's mining and dirty energy industries. Therefore, the oligarchy group in the Jokowi administration enjoys numerous benefits. Through Winter's notion of oligarchy, this study seeks to determine how omnibus law might alter the democratic political environment and pave the path for restructuring oligarchs within the current Indonesian administration. The study reveals that 18 oligarchs with ties to mining and dirty energy businesses have been pushing for Indonesia's omnibus law, including three ministers (Coordinating Minister for the Economy, Coordinating Minister for Maritime Affairs and Investment, and Minister of BUMN), one chairman of the Omnibus Law Task Force, and three vice-chairpersons. And mapping oligarchs in post-pandemic Indonesia: the old group is the Abu Rizal Bakrie groups, and the new groups are Jokowi's family groups, Luhut Binsar Panjaitan group, Airlangga Hartarto group, and Garibaldi Thohir group, all of whom receive substantial benefits from the existence of the Omnibus Law.
