Pemutusan Hubungan Kerja Buruh/Pekerja Di masa Pandemi: Resiliensi Buruh dan Advokasi Serikat Buruh Sejahtera Indonesia (SBSI) di Yogyakarta

Pandemi COVID-19 telah menyerang berbagai negara di dunia sejak akhir tahun 2019, dan mulai menyebar ke Indonesia sejak Maret 2020. Semakin banyaknya kasus masyarakat yang terinfeksi virus ini menjadikan pemerintah Indonesia menerapkan kebijakan PSBB dan lockdown di beberapa wilayah di Indonesia. Provinsi Yogyakarta merupakan salah satu provinsi yang menerapkan kebijakan lockdown akibat cepatnya persebaran virus yang menginfeksi masyarakatnya. Berdasarkan data yang diterbitkan oleh laman covid-19.go.id menyebutkan bahwasanya Yogyakarta termasuk ke dalam wilayah 10 besar tertinggi masyarakat yang terinfeksi virus COVID-19 Di Indonesia. Oleh karena itu pemerintah setempat mengupayakan berbagai upaya seperti lockdown dan juga WFH (Work From Home) bagi para pelajar dan pekerja guna mengurangi persebaran virus. Namun adanya kebijakan yang diterapkan oleh pemerintah justru menimbulkan permasalahan baru bagi masyarakat, salah satunya bagi para pekerja. Pada penelitian ini, peneliti lebih menitikberatkan mengenai permasalahan yang dialami oleh para pekerja/buruh di Yogyakarta yang mengalami permasalahan PHK akibat adanya pandemi COVID-19 dan juga peran organisasi advokasi SBSI dalam upaya mengadvokasi para pekerja atau buruh saat mengalami permasalahan hubungan industrial. Penelitian yang dilakukan oleh peneliti menggunakan metode penelitian kualitatif dengan jenis pendekatan studi kasus. Pada pendekatan studi kasus, peneliti berusaha mengulik secara mendalam peristiwa pemutusan hubungan kerja di masa pandemi supaya dapat menjelaskan situasi tersebut secara mendalam. Kriteria informan yang digunakan oleh peneliti adalah para pekerja yang mengalami PHK di masa pandemi di Yogyakarta serta pengurus organisasi advokasi SBSI. Penjelasan yang diberikan oleh narasumber digunakan untuk menjelaskan permasalahan PHK yang dialami oleh para pekerja/buruh Yogyakarta, serta untuk mengetahui peran organisasi advokasi dalam menangani kasus permasalahan hubungan ketenagakerjaan antara pihak pekerja dengan pihak pengusaha atau perusahaan. Berdasarkan penelitian yang dilakukan, memperoleh hasil yang menunjukan bahwasanya terdapat berbagai permasalahan yang dialami oleh para pekerja setelah mengalami PHK di masa pandemi. Para eks-pekerja yang mengalami PHK tidak hanya berkutat dengan perekonomian saja, namun juga harus menghadapi konflik dengan pihak perusahaan. Dalam menghadapi konflik dengan pihak pengusaha tidak sedikit kasus yang menyulitkan para eks-pekerja, sehingga perlu adanya bantuan organisasi advokasi seperti SBSI guna menangani kasus permasalahan dalam hubungan industrial.

The COVID-19 has been attacked towards various countries in the world since the last year 2019 and has been spread out to Indonesia since March 2020. The increasing number of cases that people being infected these virus made Indonesian government will implement PSBB policy and lockdown in some Indonesia areas. Yogyakarta province is the one of the provinces that implements lockdown policy because the rapid speed of the virus that infected people. Based on data published by covid19.go.id website mentioned that Yogyakarta is included in the top ten highest region that has been infected by COVID-19 virus in Indonesia. Consequently, the local government making various effort, such as lockdown and WFH (Work From Home) for students and workers to reduce the spread of the virus. However, the policies implemented by the government create new problem for the societies, especially for the workers. In this study, the researchers focused more on the problem experienced by the workers or laborers in Yogyakarta who experienced layoffs due to COVID-19 pandemic. Beside that, the researcher is also emphasizing the role of SBSI advocacy organization in an effort to advocate for the workers/laborers when experiencing industrial relation problems. The research conducted by the researcher uses qualitative research methods with case study approach. In the case study approach, researchers try to explore in depth the events of layoffs during the pandemic in order to explain the situation in depth. The criteria for informants used by the researchers were workers who experienced layoffs during pandemic in Yogyakarta and administrators of the SBSI advocacy organization. The explanations given by the resource persons are used to explain the problems of layoffs experienced by Yogyakarta workers/laborers, as well as to find out the role of advocacy organizations in handling cases of labor relations problems between workers and employers or companies. Based on the research conducted, the results show that there are various problems experienced by workers after experiencing layoffs during the pandemic. Ex-workers who have been laid off are not only struggling with the economy, but also have to face conflicts with the company. In dealing with conflicts with employers, there are not a few cases that make it difficult for ex-workers, so there is a need for assistance from advocacy organizations such as SBSI to handle cases of problems in industrial relations.
