Perlindungan Kepentingan Terbaik Bagi Anak Dalam Penyidikan Tindak Pidana Narkoba Di Kepolisian Daerah Istimewa Yogyakarta

Penelitian ini bertujuan untuk mengetahui dan menganalisis peranan Keputusan Bersama 6 Lembaga tentang Penanganan Anak yang Berkonflik dengan Hukum terhadap pelaksanaan perlindungan kepentingan terbaik bagi anak dalam penyidikan pidana narkoba di Kepolisian Daerah Istimewa Yogyakarta dan implikasi hukum yang timbul dari tidak terlaksananya perlindungan kepentingan terbaik bagi Anak dalam penyidikan tindak pidana narkoba. Penelitian hukum ini merupakan penelitian hukum normatif-empiris yang menggunakan data primer dan data sekunder. Cara memperoleh data dilakukan melalui penelitian kepustakaan serta melakukan wawancara kepada para narasumber dan responden. Analisis data menggunakan metode kualitatif, sedangkan penarikan kesimpulan dilakukan secara induktif. Hasil penelitian yang telah dilakukan penulis dapat ditarik kesimpulan bahwa: Pertama, Peranan Keputusan Bersama 6 Lembaga tentang Penanganan Anak yang Berkonflik dengan Hukum terhadap pelaksanaan perlindungan kepentingan terbaik bagi anak dalam penyidikan pidana narkoba di Kepolisian Daerah Istimewa Yogyakarta belum optimal dikarenakan belum tersediannya personil kepolisian yang memiliki sertifikasi penyidik anak dan ketiadaan RPKA guna menunjang penempatan anak sementara pasca penangkapan atau pelaksanaan pemeriksaan anak oleh penyidik. Ketiadaan penyidik dan RPKA berimplikasi tidak adanya unit dan subdit tersendiri dari Direktorat Narkoba di Polda DIY karena susunan organisasi dari Mabes Polri belum mengalami perubahan untuk mengakomodir kebutuhan adanya satuan kerja khusus tersebut. Kedua, Implikasi Hukum Yang Timbul Dari Tidak Terlaksananya Perlindungan Kepentingan Terbaik Bagi Anak Dalam Penyidikan Tindak Pidana Narkoba Di Kepolisian Daerah Istimewa Yogyakarta yaitu timbulnya dampak negatif berupa tekanan mental dan psikologis terhadap anak yang dimana dapat mengganggu pertumbuhan mental dan psikologis anak yang berkonflik dengan hukum.

This study aims to determine and analyze the role of the Joint Decree of 6 Institutions on Handling Children in Conflict with the Law on the implementation of the protection of the best interests of children in drug criminal investigations at the Yogyakarta Special Region Police and the legal implications arising from not implementing the protection of the best interests of children in investigations. drug crime. This legal research is a normative-empirical legal research that uses primary and secondary data. How to obtain data is done through library research and conducting interviews with sources and respondents. Data analysis used qualitative methods, while conclusions were drawn inductively. The results of the research that have been carried out by the author can be concluded that: First, the role of the Joint Decree of 6 Institutions on Handling Children in Conflict with the Law on the implementation of protecting the best interests of children in drug criminal investigations at the Yogyakarta Special Region Police has not been optimal due to the unavailability of police personnel who have certification of child investigators and the absence of RPKA to support the temporary placement of children after arrest or the implementation of child examination by investigators. The absence of investigators and RPKA implies the absence of a separate unit and sub-directorate of the Directorate of Drugs at Polda DIY because the organizational structure of the National Police Headquarters has not changed to accommodate the need for a special work unit. Second, the legal implications arising from the non-implementation of the best interest protection for children in drug crime investigations at the Yogyakarta Special Region Police, namely the emergence of negative impacts in the form of mental and psychological pressure on children which can interfere with the mental and psychological growth of children in conflict with the law.
