IMPLEMENTASI UNDANG-UNDANG NOMOR 11 TAHUN 2020 TENTANG CIPTA KERJA OLEH PEMERINTAH KOTA MANADO DALAM MEMACU PERTUMBUHAN INVESTASI DI ERA OTONOMI DAERAH

Undang-Undang Nmor 11 Tahun 2020 tentang Cipta Kerja telah menetapkan pengaturan baru beberapa ketentuan yang diatur dalam Undang-Undang Nomor 25 Tahun 2007 tentang Penanaman Modal. Tujuan dari penelitian ini adalah untuk mengetahui dan menganalisis penerapan kewenangan Pemerintah Kota Manado dalam memacu Pertumbuhan Investasi di era Otonomi Daerah di kota Manado serta menganalisa kendala yang di hadapi oleh Pemerintah Kota Manado dalam memacu pertumbuhan investasi di era Otonomi Daerah berdasarkan implentasi Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja. Penelitian ini memiliki sifat deskriptif analitis dengan jenis penelitian menggunakan metode normatif empiris. Sumber data yang digunakan yaitu menggunakan data primer yang diperoleh dengan metode wawancara narasumber dan responden, dan data sekunder berupa bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier yang diperoleh melalui studi kepustakaan. Data yang diperoleh dalam penelitian ini dianalisis secara kualitatif. Kesimpulan dalam penelitian ini yaitu bahwa Pemerintah Daerah Kota Manado telah mengikuti arahan dan melaksanakan pemberlakuan dalam hal penanaman modal dan perizinan yang diatur dalam Undang-Undang Nomor 11 Tahun 2020 Tentang Cipta Kerja. Pemerintah Daerah Kota Manado juga telah melakukan harmonisasi pemberlakuan pemberian perizinan melalui sistem OSS.RBA yang terbaru dan juga penangananan pemberian dan pengawasan izin yang dilaksanakan sesuai aturan Pemerintah Pusat. Kendala yang dihadapi oleh Pemerintah Kota Manado dalam memacu pertumbuhan investasi di era Otonomi Daerah berdasarkan implentasi Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja yaitu ditemukan adanya rekofusing pengalokasian dana dimana dana yang dimiliki oleh daerah semua terfokus ke penangan pandemi Covid-19 dan DPMPTSP Kota Manado, sebetulnya belum lama disahkan. DPMPTSP disahkan pada tahun 2019 dan setelah itu terjadi pemilihan Wali Kota, sehingga terjadi pergantian posisi struktural dan hingga kini perencanaan perencanaan yang telah dibuat semua tertunda dan belum terlaksana. Kendala dari pihak Pemerintah Daerah, bahwa Pemerintah Daerah belum bisa mengeluarkan kebijakan yang dapat memacu pertumbuhan investasi di daerah karena terhambat pada pandemic Covid-19, sehingga dana yang dimilki, kurang memadai dan Pemerintah Daerah selama ini hanya mengikuti kebijakan yang perintahkan oleh Pemerintah Pusat.

Law Number 11 of 2020 concerning Job Creation has set out new arrangements for several provisions stipulated in Law Number 25 of 2007 concerning Investment. The purpose of this study is to find out and analyze the application of the Manado City Government in spurring investment growth in the era of Regional Autonomy in Manado City and analyze the obstacles faced by the Manado City Government in spurring investment growth in the Regional Autonomy era based on Law Number 11 of 2020 about job creation. The research has a descriptive analytical nature with this type of research using empirical normative methods. The data sources used are primary data obtained by interviewing sources and respondents, and secondary data in the form of primary legal materials, secondary legal materials, and tertiary legal materials obtained through library studies. The data obtained in this study were analyzed qualitatively. The conclusion in this research is that the Manado City Government has followed the directions and implemented the implementation in terms of investment and licensing regulated in Law Number 11 of 2020 concerning Job Creation. The Manado City Government has also harmonized the application of licensing through the latest OSS.RBA system as well as handling the granting and supervision of permits carried out in accordance with Central Government regulations. The obstacle faced by the Manado City Government in spurring investment growth in the era of Regional Autonomy based on the implementation of Law Number 11 of 2020 concerning Job Creation, namely the finding of re-allocation of funds where funds owned by the regions are all focused on handling the Covid-19 pandemic and the City DPMPTSP. Manado, actually not long ago it was ratified. The DPMPTSP was ratified in 2019 and after that the mayoral election took place, resulting in a change in structural positions and until now all the planning plans that have been made have been delayed and have not been implemented. The obstacle from the Regional Government is that the Regional Government has not been able to issue policies that can spur investment growth in the region because it is hampered by the Covid-19 pandemic, so that the funds they have are inadequate and the Regional Government has only followed the policies ordered by the Central Government.
