Legal Analysis of The Abandoned Children and Abandoned Children With Diffability in Sleman Based on Local Regulation of Daerah Istimewa Yogyakarta No. 2 Year 2018 on The Implementation of Children Protection

Undang-Undang Dasar Tahun 1945 menyatakan dalam pasal 34: "Fakir miskin dan anak terlantar dipelihara oleh negara". Pemerintah mempunyai kewajiban untuk menampung, mengasihi dan menyupport tumbuh kembang anak. Dan juga di pasal 28B Alinea 2 tertulis: "Setiap anak mempunyai hak untuk hidup, bertumbuh kembang, dan mempunyai hak untuk mendapatkan perlindungan dari kekerasan dan diskriminasi". Penulisan hukum ini bertujuan untuk mendapatkan analisis hukum dari Peraturan Daerah Provinsi Daerah Istimewa Yogyakarta No. 2 Tahun 2018 terhadap anak terlantar serta pengaruh dari peraturan tersebut terhadap anak terlantar terutama anak penyandang disabilitas. Topik ini ditulis oleh penulis atas dasar tanggapan yang didasari oleh penulisan dan literatur yang secara khusus membahas tentang perlindungan terhadap anak terlantar masih terbatas terutama di daerah Sleman. Pentingnya penelitian lebih lanjut tentang topik ini karena dengan pengertian lebih dan mengetahui kendala dari perlindungan anak untuk anak terlantar dengan disabilitas karena setiap anak mempunyai hak yang setara untuk mendapatkan perhatian, kasih sayang, dan perlindungan oleh negara, masyarakat dan wali orang tua maupun wali keluarga.

The Indonesian 1945 Constitution stated in article 34: "Impoverished person and abandoned children shall be taken care of by the State." Government has the responsibility of sheltering, attending, and supporting children's development. As well in article 28B (2) stated: "Every child shall have the right to live, to grow and to develop, and shall have the right to be protected from violence and discrimination.". This legal research is aimed to analyse the legal projection of Local Regulation of Daerah Istimewa Yogyakarta No. 2 Year 2018 towards abandoned children and the impact made by the regulation for abandoned children and especially with children with disability. This legal research in this particular topic is written by the author as the response to notion based by the study and literature regarding children protection that particularly talked about abandoned children is still lacking foremostly in Sleman in the first place. It is important for further research regarding this topic because with understanding the importance and obstacle of children protection for abandoned children with disability because every child has equal rights to be taken care of, indulged, educated, and protected by the state, community, and their adult guardians whether parents or family.
