Kajian Yuridis Terhadap Kerjasama Antara Notaris Dengan Bank Ditinjau Dari Kode Etik Notaris

Penelitian ini bertujuan untuk mengetahui dan menganalisis hakikat kerjasama antara notaris dengan bank yang tidak melanggar Kode Etik Notaris dan untuk mengetahui dan menganalisis tindakan dari Dewan Kehormatan Notaris Daerah di Kabupaten Sleman selaku penegak Kode Etik Notaris sehubungan dengan adanya kerjasama antara notaris dengan bank. Penelitian ini menggunakan metode penelitian hukum normatif. Data yang digunakan adalah data sekunder. Subjek di dalam penelitian ini adalah narasumber. Pengumpulan data diperoleh melalui studi kepustakaan dan wawancara dengan beberapa narasumber. Data yang ada kemudian diolah dan dianalisis dengan menggunakan metode deskriptif kualitatif. Metode Kualitatif merupakan data yang diperoleh dari hasil wawancara dengan narasumber serta hasil dari studi kepustakaan. Setelah data dianalisis kemudian ditarik kesimpulan dengan metode berpikir/bernalar secara deduktif, yakni berawal dari proposisi yang bersifat umum berupa peraturan perundang-undangan berakhir pada kesimpulan yang bersifat khusus berupa hasil penelitian. Hasil penelitian menunjukkan bahwa perjanjian kerjasama antara notaris dengan bank hanya merupakan perjanjian kerjasama berupa MoU biasa yang berisi bahwa notaris yang bersangkutan berkenan untuk mengurus mengenai seluruh legalitas dan syarat-syarat legalitasnya yang berkaitan dengan kegiatan usaha perbankan, sehingga tidak melanggar ketentuan sebagaimana yang diatur dalam Kode Etik Notaris. Dewan Kehormatan Notaris Daerah di Kabupaten Sleman memberikan tindakan terhadap pelanggaran Kode Etik Notaris ketika terdapat aduan pelanggaran notaris atas kerjasama tersebut, kemudian Dewan Kehormatan Notaris akan menyelidiki dan ketika terbukti melakukan pelanggaran, maka Dewan Kehormatan Notaris akan memberikan sanksi berupa teguran tertulis.

This research aims to understand and to analyze the profound facts regarding the partnership between notary and bank which does not violate the Code of Notary Ethics and to understand and to analyze the measures taken by the Notary Honor Council of the Sleman regency as the enforcer of the Code of Notary Ethics in regards to the existence of the partnership between notary and bank. This legal research used the normative method. The data being used is secondary data. Subjects within this research are informants. The data was gathered through a literature study and interviews with some informants as sources. Thereafter, the data were processed and analyzed using the qualitative descriptive method. The qualitative method is a method in which the data are gathered from interviews with sources and literature studies. After the analysis process, then a conclusion is taken using the deductive thinking method, which began with the general proposition which is the regulation itself and ended with the more specific conclusion, which is the result of the research. The result of this research shows the partnership agreement between a notary and a bank is only a partnership agreement in the form of an ordinary MoU which contains that the notary concerned is willing to take care of all legalities and legal requirements relating to banking business activities so that they do not violate the provisions as stipulated in the Notary Code of Ethics. The Notary Honor Council of the Sleman regency has done some measures in regards to the violation of the Code of Notary Ethics when there was a complaint concerning that violation, thus the Notary of Honor Council would investigate and if the violation is confirmed through it, the Notary Honor Council would give sanction which is a letter of reprimand.
