ANALISIS TERHADAP KONTRAK PENGADAAN BARANG/JASA PEMERINTAH DALAM PENANGANAN KEADAAN DARURAT BERDASARKAN PERATURAN LEMBAGA KEBIJAKAN PENGADAAN BARANG/JASA PEMERINTAH NOMOR 13 TAHUN 2018 TENTANG PENGADAAN BARANG/JASA DALAM PENANGANAN KEADAAN DARURAT

Penelitian ini bertujuan untuk mengetahui kedudukan dan hirearki Peraturan LKPP 13/2018 dalam sistem hukum nasional dan sinkronisasinya dengan Perpres PBJ dan Peraturan Menteri Keuangan No. 43/PMK.05/2020, serta kedudukan dan fungsi kontrak PBJ dalam penanganan keadaan darurat. Jenis penelitian ini adalah penelitian hukum normatif. Data yang digunakan adalah data sekunder yang diperoleh dari bahan Pustaka. Hasil penelitian dianalisis dengan metode kualitatif yang bersifat deskriptif. Berdasarkan penelitian ini diperoleh hasil bahwa pertama, kedudukan Peraturan LKPP 13/2018 adalah peraturan delegasi dari Pasal 91 angka (1) huruf p Perpres PBJ. Fungsi materi muatan Peraturan LKPP 13/2018 adalah mengatur ketentuan lebih lanjut/prosedural dari pasal 59 Perpres PBJ. Meskipun Peraturan LKPP 13/2018 bermanfaat memberikan pedoman untuk melaksanakan PBJ dalam keadaan darurat, namun Peraturan a quo tidak memiliki kewenangan untuk menyimpangi ketentuan dalam Perpres PBJ, sepanjang tidak diamanatkan pada pasal 59 Perpres PBJ. Kedua, kedudukan dan fungsi Kontrak PBJ Penanganan keadaan darurat adalah sebagai komitmen yang merupakan dasar tindakan PPK untuk melaksanakan anggaran belanja negara dalam keadaan darurat dan dasar dari penyedia untuk melaksanakan pekerjaan karena itu kontrak harus dibentuk sebelum pelaksanaan pekerjaan. Pembentukan kontrak setelah serah terima barang/jasa bertentangan dengan kedudukan dan hakikat kontrak PBJ sebagai bentuk komitmen dan dasar melaksanakan pekerjaan. Ketiga, ketentuan tentang kontrak pada Peraturan LKPP 13/2018 menyimpangi dan bertentangan dengan ketentuan pada Perpres PBJ dan PMK No. 43/PMK.05/2020. Ketentuan tentang kontrak PBJ penanganan keadaan darurat tetap mengacu pada Perpres PBJ yakni dibentuk sebelum pelaksanaan pekerjaan.

This study aims to determine the position and hierarchy of LKPP Regulation 13/2018 and its synchronization with Presidential Regulation 16/2018 on Public Procurement and Minister of Finance Regulation Number. 43/PMK.05/2020, and the position and function of the procurement contract for emergencies handling. Type of research is normative legal. The data used is secondary data obtained from library materials. The results of the study were analyzed using a descriptive qualitative method. Based on this research, the results show that first, the position of LKPP Regulation number 13/2018 is the delegation regulation from Article 91 paragraph (1) letter p of the Presidential Regulation 16/2018. The content of LKPP Regulation 13/2018 is to regulate further provisions/procedurals of Article 59 of the Presidential Regulation 16/2018. Although LKPP Regulation 13/2018 is useful in providing guidelines for implementing procurement for emergency handling, however a quo regulation does not have the authority to deviate of the Presidential Regulation 16/2018 provisions, as long as it is not regulated in Article 59 of the Presidential Regulation 16/2018. Second, the position and function of the Procurement Contract in handling emergencies is a commitment that is the basis of PPK's actions to carry out the state budget for emergency handling and the basis of the Vendor to carry out the work, therefore a contract must be formed before the execution of the work. The formation of a contract after the handover of goods/services is contrary to the position and nature of the procurement contract as a form of commitment and basis to carry out work. Third, provisions on contracts in LKPP Regulation 13/2018 deviate and contradict the Presidential Regulation 16/2018 provisions and Minister of Finance Regulation 43/PMK.05/2020. Provisions on procurement contracts for handling emergencies still refer to Presidential Decree 16/2018, which is formed before the execution of work.
