Judge Consideration Incapacitation on Juvenile Crimes in Narcotics Cases : Perspective Of The Best Interest Of The Child Principle

Penelitian Hukum ini bertujuan untuk menganalisis bagaimana asas kepentingan terbaik anak diatur dalam skala global dan menganalisis pertimbangan hakim terhadap studi kasus apakah sudah sesuai dengan asas kepentingan terbaik anak atau belum. Penelitian hukum ini menggunakan pendekatan normatif. Di dalamnya terdiri dari literatur terkait seperti buku dan jurnal serta literatur pendukung lainnya yang akan mendukung penelitian hukum ini. Data tersebut akan menjadi data sekunder. Data tersebut akan dianalisis dengan metode deskriptif dimana literatur dan hukum akan dianalisis dengan studi kasus dan dalam penelitian hukum ini adalah studi kasus pidana anak.. Hasil penelitian hukum ini adalah bahwa (1)peraturan mengenai asas kepentingan terbaik bagi anak dalam skala global diatur melalui konvensi internasional yang akan diratifikasi di negara-negara penandatangan hukum nasional untuk dilaksanakan sebagai peraturan perundang-undangan.(2) analisis hakim dalam arti positif telah memenuhi semua elemen yang diperlukan untuk memberikan keputusan terhadap anak dalam studi kasus. Dalam memberikan putusan para hakim dalam studi kasus telah sesuai dengan Undang-Undang Kekuasaan Kehakiman No.48 Tahun 2009 Para hakim dalam studi kasus telah menerapkan unsur-unsur yang tercantum dalam ketentuan undang-undang ke dalam kasus pidana anak secara akurat dan telah memberikan putusan dalam sesuai dengan ketentuan undang-undang tersebut. pemenjaraan tidak sesuai dengan kepentingan terbaik bagi anak. Penyalahgunaan narkotika dianggap sebagai kejahatan tanpa korban. Oleh karena itu cara-cara alternatif seperti diversi dan rehabilitasi (medis dan/atau sosial) lebih cocok diterapkan kepada seorang anak demi kepentingan terbaiknya dan juga untuk mereformasi anak tersebut agar dapat berintegrasi kembali dengan masyarakat

This Legal Research is aimed to analyze on how the best interest of the child principle is regulated in a global scale and to analyze the judge consideration of the case studies whether it is already in accordance with the best interest of the child principle or not. The legal research uses normative approach. In which it consists of related literature such as books and journals and other supporting literature that would support this legal research. The data will be secondary data. The data will be analyzed with descriptive method in which the literature and laws will be analyzed with the case studies and in this legal research is juvenile case studies. The result of this legal research is that (1)The regulations regarding the best interest of the child principle in the global scale is regulated through international conventions that will be ratified in the contracting states national law to be implemented as regulating laws.(2) The judge analysis in the positive sense has fulfilled all the elements needed for rendering a decision towards the juveniles in the case studies. In rendering the decision the judges in the case studies has been in accordance with the Judicial Powers Law No.48 of 2009 The judges in the case studies has implement the elements stated in the laws provisions into the juvenile case accurately and has render a judgement in accordance to those law stipulations. Imprisonment is not in accordance with the best interest of the child. The narcotics abuse is considered a victimless crime. Therefore alternative methods such as diversion and rehabilitation (medical and/or social) are more suitable to be imposed towards a juvenile for the sake of their best interest and also to reform the juvenile so that they can reintegrate the society.
