PEMBATALAN PERJANJIAN PENGIKATAN JUAL BELI TANAH DAN BANGUNAN OLEH CALON AHLI WARIS DI DESA CATURTUNGGAL, KECAMATAN DEPOK, KABUPATEN SLEMAN, DAERAH ISTIMEWA YOGYAKARTA

Penelitian ini bertujuan untuk menganalisis akibat hukum pembatalan perjanjian pengikatan jual beli tanah dan bangunan oleh calon ahli waris kepada pembeli dan untuk menganalisis kesesuaian penerapan pembatalan perjanjian pengikatan jual beli tanah dan bangunan oleh calon ahli waris di Desa Caturtunggal, Kecamatan Depok, Kabupaten Sleman, Daerah Istimewa Yogyakarta dengan ketentuan yang berlaku sebagai salah satu prosedur yang harus dilakukan. Penelitian ini merupakan penelitian hukum yuridis empiris yang dilakukan secara langsung kepada masyarakat untuk memperoleh data primer. Analisis data dilakukan dengan menggunakan pendekatan kualitatif dan hasilnya disajikan secara deskriptif. Penarikan kesimpulan dalam penelitian ini menggunakan cara berpikir induksi, yaitu dengan mencari prinsip-prinsip ilmu hukum dalam gejala yang ada untuk dianalisis dengan prinsip-prinsip ilmu hukum yang telah ada, sehingga menghasilkan suatu kesimpulan. Berdasarkan hasil penelitian, akibat pembatalan PPJB tanah dan bangunan oleh calon ahli waris terhadap pembeli menyebabkan pembeli mengalami kerugian materiil dan pembeli tidak dapat lagi menguasai objek perjanjian berupa tanah dan bangunan karena objek dalam PPJB telah beralih kepada pembeli baru. Penerapan pembatalan perjanjian pengikatan jual beli tanah dan bangunan oleh calon ahli waris belum sesuai ketentuan yang berlaku sebab menurut Pasal 833 KUHPerdata. Dalam pembatalan adanya penipuan maka berdasarkan Pasal 1328 KUHPerdata bahwa penipuan merupakan suatu alasan untuk pembatalan perjanjian. Pembuatan PPJB yang telah dilakukan pun tidak memenuhi syarat subjektif menurut Pasal 1320 KUHPerdata maka ketika tidak terpenuhinya syarat subjektif pihak yang bersangkutan dapat memintakan pembatalan PPJB.

This aims of this research to analyze the legal consequences of the revocation of sale and purchase agreement of land and buildings by the prospective heirs to the buyer and to analyze the suitability of the application of the revocation of the binding sale and purchase agreement of land and buildings by the prospective heirs in Caturtunggal Village, Depok District, Sleman Regency, Special Region of Yogyakarta with the applicable provisions as one of the procedures that must be carried out. This research is an empirical juridical law research conducted directly to the public to obtain primary data. Data analysis was carried out using a qualitative approach and the results were presented descriptively. Drawing conclusions in this study using induction thinking, namely by looking for the principles of legal science in existing phenomena to be analyzed with existing legal principles, so as to produce a conclusion. Based on the results of the study, due to the revocation of the sale of purchase agreement of land and buildings by the prospective heirs to the buyer, the buyer suffered material losses and the buyer could no longer control the object of the agreement in the form of land and buildings because the object in the sale of purchase agreement had been transferred to a new buyer. The application of the revocation of sale and purchase agreement of land and buildings by the prospective heirs has not been in accordance with the applicable provisions because according to Article 833 of the Indonesian Civil Code. In the revocation of the existence of fraud, it is based on Article 1328 of the Indonesian Civil Code that fraud is a reason for the revocation of the agreement. The sale of purchase agreement making that has been carried out does not meet the subjective requirements according to Article 1320 of the Indonesian Civil Code, so when the subjective requirements are not fulfilled, the party concerned can request the revocation of the sale of purchase agreement.
