IMPLIKASI PRINSIP KONSENSUS TERHADAP KEBULATAN SUARA DALAM PEMILIHAN DIREKTUR JENDERAL WORLD TRADE ORGANIZATION 2020

Penelitian dalam Penulisan Hukum ini bertujuan untuk mengetahui dan menganalisis pelaksanaan serta implikasi prinsip konsensus yang dianut oleh World Trade Organization (WTO) dalam pengambilan keputusan, pada khususnya implikasinya terhadap kebulatan suara dalam pemilihan Direktur Jenderal WTO periode 2020. Penelitian ini merupakan penelitian hukum normatif-empiris dengan mengelaborasi data primer dari hasil wawancara dengan narasumber dan data sekunder yang diperoleh melalui penelusuran pustaka. Data dianalisis dengan menggunakan metode kualitatif yang selanjutnya dituangkan dalam bentuk penjelasan untuk menarik kesimpulan yang dilakukan secara objektif dan sistematis. Data primer diperoleh melalui wawancara yang penulis lakukan dengan Perutusan Tetap Republik Indonesia di Jenewa (PTRI Jenewa) yang mewakili Indonesia sebagai Member States di WTO dan mengikuti proses pemilihan Direktur Jenderal WTO periode 2020. Sedangkan, data sekunder diperoleh oleh penulis melalui buku, jurnal, publikasi, dan bahan kepustakaan lainnya yang absah. Kemudian, data yang diperoleh kemudian diolah secara deskriptif kualitatif. Berdasarkan penelitian ini, diperoleh kesimpulan bahwa prinsip konsensus yang sudah sejak awal pendiriannya digunakan oleh WTO dalam pengambilan keputusan organisasi yang salah satunya adalah pemilihan Dirjen WTO periode 2020. Sebagaimana, WTO adalah organisasi member-driven, keanggotaannya yang terus bertambah menjadi tantangan dalam mencapai kebulatan suara. Prinsip konsensus juga berimplikasi terhadap kebulatan suara yang hendak dicapai dalam pemilihan Dirjen WTO periode 2020, hal tersebut mempengaruhi efisiensinya, dalam hal terjadi blokade konsensus yang dilakukan oleh Amerika Serikat dan beberapa negara lain, mengakibatkan proses pemilihan Dirjen WTO periode 2020 melewati batas waktu yang telah ditentukan oleh WT/L/509 dan membuat WTO menjadi leaderless selama beberapa waktu di tengah krisis dan pandemi global.

This Legal Writing aims to identify and analyze the implementation and implications of the consensus principle adopted by the World Trade Organization (WTO) in decision making, in particular its implications for unanimity in the election of the Director General of the WTO for the period 2020. This research is normative-empirical legal research, by elaborating primary data from interviews with resource persons and secondary data obtained through library research. The data were analyzed using qualitative methods which were then poured in the form of explanations to draw conclusions that were carried out objectively and systematically. Primary data was obtained through interviews that the authors conducted with the Permanent Mission of the Republic of Indonesia in Geneva who represented Indonesia as Member States in the WTO and participated in the process of selecting the Director General of the WTO for the 2020 period. Meanwhile, secondary data were obtained by the author through books, journals, publications, and other valid bibliography. Then, the data obtained was then processed in a qualitative descriptive manner. Based on this research, it is concluded that the consensus principle has been used since the beginning of its establishment by the WTO in making organizational decisions, one of which is the election of the Director General of the WTO for the 2020 period. As the WTO is a member-driven organization, its membership that continues to grow is a challenge in achieving unanimity. The principle of consensus also has implications for the unanimity to be achieved in the election of the Director General of the WTO for the 2020 period, this affects its efficiency, in the event of a consensus blockade carried out by the United States and several other countries, resulting in the process of selecting the Director General of the WTO for the 2020 period exceeding the predetermined time limit by the WT/L/509 and made the WTO leaderless for some time in the midst of global crises and pandemics.
