Perlindungan Hukum Bagi Dokter Gigi Melalui Informed Consent Selama Masa Pandemi COVID-19 di RSGM UGM Prof. Soedomo

Penelitian hukum ini bertujuan untuk mengetahui kesesuaian pelaksanaan informed consent dengan ketentuan dalam PERMENKES Nomor 290/MENKES/PER/III/2008 tentang Persetujuan Tindakan Kedokteran, serta kesesuaian pelaksanaan Standar Prosedur Operasional (SPO) di RSGM UGM Prof. Soedomo selama masa pandemi COVID-19 dengan SE No. 2776/PB PDGI/III-3/2020 tentang Pedoman Pelayanan Kedokteran Gigi Selama Pandemi Virus COVID-19. Selain itu, untuk mengetahui informed consent di RSGM UGM Prof. Soedomo selama masa pandemi COVID-19, sudah memberikan atau belum memberikan perlindungan hukum dan perlindungan kesehatan bagi dokter gigi ketika memberikan tindakan kedokteran gigi. Penelitian ini dikategorikan sebagai penelitian normatif-empiris, yang menggabungkan antara penelitian kepustakaan dan penelitian lapangan. Data yang didapatkan yaitu data primer dan data sekunder melalui penelitian lapangan dan penelitian kepustakaan. Teknik pengumpulan data dilakukan dengan melakukan wawancara kepada responden serta penelusuran kepustakaan. Penelitian ini menggunakan analisis kualitatif dan disajikan secara deskriptif. Dari penelitian hukum ini diketahui bahwa pelaksanaan informed consent dan Standar Prosedur Operasional (SPO) di RSGM UGM Prof. Soedomo selama masa pandemi COVID-19 sudah sesuai dengan ketentuan dalam PERMENKES Nomor 290/MENKES/PER/III/2008 tentang Persetujuan Tindakan Kedokteran dan dengan SE No. 2776/PB PDGI/III-3/2020 tentang Pedoman Pelayanan Kedokteran Gigi Selama Pandemi Virus COVID-19. Informed consent di RSGM UGM Prof. Soedomo selama masa pandemi COVID-19 sudah memberikan perlindungan hukum namun dapat memberikan perlindungan kesehatan bagi dokter gigi.

This research aims to find out the suitability of the implementation of informed consent with the regulation in PERMENKES No. 290/MENKES/PER/III/2008 concerning Medical Action Approval, and the suitability of the implementation of Standard Operating Procedure (SPO) at RSGM UGM Prof. Soedomo during the period of COVID-19 with SE No. 2776/PB PDGI/III-3/2020 concerning Guidelines for Dental Services During the COVID-19 Virus Pandemic. Furthermore, to find out whether the informed consent at RSGM UGM Prof. Soedomo during Covid-19 Pandemic, is already give legal protection and medical protection for dentist while provide dentistry action. This research is categorized as a normative-empirical research, which is a combination of library research and field research. The data obtained are primary data and secondary data through field research and library research. The data collection technique was carried out by conducting interviews with respondents and library research. This research uses qualitative analysis and is presented descriptively. From this research, it is known that the implementation of informed consent and Standard Operating Procedure (SPO) at RSGM UGM Prof. Soedomo during the Covid-19 pandemic is in accordance with the regulation in PERMENKES No. 290/MENKES/PER/III/2009 concerning Medical Action Approval and with SE No. 2776/PB PDGI/III-3/2020 concerning Guidelines for Dental Services During the period of COVID-19 Virus Pandemic. Informed consent at RSGM UGM Prof. Soedomo during the Covid-19 pandemic has provided legal protection but, has not been able to provide health protection for dentist.
