PELAKSANAAN PEMBINAAN DAN PENGAWASAN TERHADAP PEJABAT PEMBUAT AKTA TANAH OLEH MAJELIS PEMBINA DAN PENGAWAS DAERAH DAN KANTOR PERTANAHAN DI KABUPATEN PANGANDARAN

MPPD memiliki peran untuk membantu Kantor Pertanahan dalam melakukan pembinaan dan pengawasan terhadap PPAT. Apabila terdapat temuan atau pengaduan pelanggaran maka MPPD memiliki kewenangan untuk menindaklanjuti hal tersebut. Tujuan dari penelitian ini adalah untuk mengetahui, menganalisis dan mendeskripsikan pelaksanaan fungsi pembinaan dan pengawasan MPPD dan Kantor Pertanahan terhadap PPAT serta faktor kendala dalam pelaksanaan fungsi pembinaan dan pengawasan tersebut di Kabupaten Pangandaran. Penelitian ini adalah penelitian yuridis normatif-empiris, dengan sifat deskriptif. Data yang digunakan adalah data primer dan data sekunder. Data primer bersumber dari penelitian lapangan yaitu dari subjek penelitian responden dan narasumber. Data sekunder yaitu terdiri dari bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Analisis data dilakukan secara kualitatif. Kesimpulan penelitian menunjukkan bahwa, pelaksanaan fungsi pembinaan dan pengawasan oleh MPPD dan Kantor Pertanahan terhadap PPAT di Kabupaten Pangandaran belum efektif. Aduan atau temuan atas pelanggaran yang dilakukan oleh PPAT tidak ditindaklanjuti secara tegas oleh MPPD. MPPD tidak memberikan rekomendasi apapun kepada Kantor Pertanahan dan Kantor Pertanahan tidak memberikan sanksi administratif apapun atas pelanggaran yang dilakukan oleh PPAT. Kedua, kendala MPPD dan Kantor Pertanahan dalam pelaksanaan pembinaan dan pengawasan terhadap PPAT yaitu penunjukan anggota MPPD yang dipilih secara subyektif oleh Kantor Pertanahan dan IPPAT, anggota MPPD PPAT tidak bertanggungjawab dalam menjalankan tugasnya sehingga pelaksanaan pembinaan dan pengawasan terhadap PPAT tidak efektif. Perpindahan Kepala Kantor Pertanahan sebagai Ketua MPPD mengubah struktur keanggotaan MPPD dan mempengaruhi kinerja MPPD PPAT sebab setiap Ketua MPPD memiliki kebijakan yang berbeda dalam menindaklanjuti suatu permasalahan.

The Local Supervisory Council has a role to help the Regional Land Office to conduct development and supervision to the Land Deed Officer. If there are findings of violations, the Local Supervisory Council has the authority to investigate the violations. The purpose of this research is to analyze and describe regarding to the implementation of the supervisory and development functions by the Local Supervisory Council and the Regional Land Office as well as the obstacle of its implementation in Pangandaran District. This type of research uses empirical normative research. The type of research data is primary data and secondary data. Primary data obtained through direct field research, namely respondents and resource people. Secondary data is regarding on the collection of materials related to the topic of research. Secondary data consist of primary legal materials, secondary legal materials and tertiary legal materials. The data analysis conducted by qualitative manner. The conclusion of the research shows the implementation of the development and supervision functions by the Local Supervision Council and the Regional Land Office to Land Deed Office in Pangandaran District is not effective. The Local Supervisory Council does not give any recommendations and the Regional Land Office does not give any administrative sanctions to the Land Deed Office who commit violations. Second, obstacle of the implementation of the development and supervision functions by the Local Supervision Council and the Regional Land Office to Land Deed Office in Pangandaran District is the member of MPPD appointed by the Regional Land Office and IPPAT subjectively, the member of the Local Supervisory Council who are not responsible to its position influence the effectiveness of implementation of the development and supervision. Mutation of the Head of Regional Land Office has changes the structure of the Local Supervisory Council members so it influence the performance of the MPPD because each Head of The Regional Land Office has different policy to solve the problems.
