Analisis Akibat Hukum Holding BUMN Jasa Survei Terhadap Aspek Ketenagakerjaan di Perusahaan Anggota Holding

Penelitian ini bertujuan untuk mengetahui dan menganalisis akibat hukum atas pembentukan Holding BUMN Jasa Survei, akibat hukum atas perubahan status badan usaha perusahaan anggota Holding BUMN Jasa Survei terhadap aspek ketenagakerjaan, serta perlindungan hukum atas hak-hak pekerja akibat perubahan status perusahaan dari BUMN menjadi anak perusahaan BUMN. Penelitian ini merupakan penelitian hukum empiris yang dilakukan melalui penelitian lapangan guna mendapatkan data primer melalui wawancara kepada responden. Data hasil penelitian dianalisis secara deskriptif kualitatif dengan menggunakan metode berpikir deduktif. Hasil penelitian menunjukkan: Pertama, akibat hukum dari adanya pembentukan Holding BUMN Jasa Survei adalah perubahan status Perusahaan Perseroan (Persero) PT Sucofindo dan Perusahaan Perseroan (Persero) PT Surveyor Indonesia yang sebelumnya BUMN menjadi anak perusahaan BUMN, yaitu PT Biro Klasifikasi Indonesia (Persero), dengan status BUMS berbentuk Perseroan Terbatas yang tunduk sepenuhnya pada Undang-Undang Nomor 40 Tahun 2007 tentang Perseroan Terbatas dan tidak lagi berstatus Perusahaan Perseroan. Kedua, peristiwa holding berdampak pada aspek ketenagakerjaan diantaranya perubahan status ketenagakerjaan di perusahaan anggota holding dimana pekerja PT Sucofindo (Persero) dan PT Surveyor Indonesia (Persero) tidak lagi berstatus karyawan BUMN dan beralih menjadi karyawan swasta. Ketiga, hak-hak pekerja pada PT Sucofindo (Persero) dan PT Surveyor Indonesia (Persero) secara preventif telah terlindungi karena telah diatur pada perjanjian kerja dan Perjanjian Kerja Bersama (PKB) sebagai wadah pengaturan hak dan kewajiban pekerja.

This study aims to identify and analyze legal aspects on the formation of a State-Owned Enterprise (SOE) Holding Company of Survey Cluster, its legal consequences of the changes the status of a business entity member companies SOE Holding Company of Survey Cluster on employment aspects, as well as legal protection of workers' rights due to the change in company status from SOE to become a subsidiary of SOE. This research is an empirical legal research conducted through field research in order to obtain primary data through interviews with respondents. The research data were analyzed descriptively qualitatively by using deductive thinking methods. The results showed: First, the legal consequence of the establishment Holding of a SOE Holding Company of Survey Cluster is a change in the status of Perusahaan Perseroan (Persero) PT Sucofindo and Perusahaan Perseroan (Persero) PT Surveyor Indonesia which was previously a SOE to become a subsidiary of SOE, namely PT Biro Klasifikasi Indonesia (Persero), with the status of Limited Liability Company and submit completely to Limited Company Consitution. Second,events holding have an impact on employment aspects, including changes in employment status inmember companies holding where employees of PT Sucofindo (Persero) and PT Surveyor Indonesia (Persero) no longer have the status of SOE employees and switch to private employees. Third, the rights of workers at PT Sucofindo (Persero) and PT Surveyor Indonesia (Persero) have been preventively protected because they have been regulated in the work agreement and Collective Labor Agreement as a forum for regulating the rights and obligations of workers.
