PENGAWASAN TERHADAP KEPATUHAN KODE ETIK PEJABAT PEMBUAT AKTA TANAH OLEH IKATAN PEJABAT PEMBUAT AKTA TANAH DI KABUPATEN BOYOLALI

Penelitian ini bertujuan untuk mengetahui dan menganalisis kompleksitas masalah yang berkaitan dengan pengawasan terhadap kepatuhan kode etik Pejabat Pembuat Akta Tanah (PPAT) oleh Ikatan Pejabat Pembuat Akta Tanah (IPPAT) di Kabupaten Boyolali, serta untuk mengetahui dan menganalisis kendala yang dihadapi oleh IPPAT dalam pengawasan terhadap kepatuhan kode etik PPAT di Kabupaten Boyolali. Penelitian dilakukan dengan metode penelitian hukum normatif empiris dengan data primer yang diperoleh dari wawancara kepada subjek penelitian dan data sekunder yang mengacu pada bahan-bahan hukum yang berkaitan dengan permasalahan. Penelitian ini bersifat deskriptif dan dianalisis secara kualitatif. Berdasarkan hasil penelitian dapat disimpulkan bahwa IPPAT melalui alat kelengkapannya yaitu Pengurus Daerah, Majelis Kehormatan Daerah, Pengurus Wilayah, dan seluruh anggota IPPAT Kabupaten Boyolali telah melakukan upaya-upaya pengawasan untuk meminimalisir pelanggaran terhadap kode etik PPAT yang berupa penanaman tekad pada diri sendiri untuk patuh terhadap aturan-aturan yang melingkupi jabatan PPAT, pemberian himbauan dalam forum perkumpulan baik formal maupun informal, dan pemberian teguran dengan cara yang santun, tidak menggurui dan terhormat. Kendala yang ditemui IPPAT berupa kendala internal yang datangnya dari dalam pribadi masing-masing yaitu berupa adanya PPAT yang tersinggung atau tidak terima ketika diberi teguran atas pelanggaran yang terjadi, perasaan sungkan atau perasaan yang tidak enak ketika hendak menegur rekan PPAT yang melakukan pelanggaran, dan merasa tidak memperoleh keuntungan jika menegur rekan yang melakukan pelanggaran kode etik. Selain itu IPPAT juga menjumpai kendala eksternal yang datangnya dari lingkungan sekitar yaitu berupa adanya permakluman terhadap pelanggaran yang terjadi dan juga adanya PPAT yang menolak bergabung ke dalam IPPAT Kabupaten Boyolali.

This research aims at finding out and analyzing the complexity of issues related to the oversight towards to the obedience of the Land Deed Official code of ethic by Land Deed Official Association in Boyolali District, as well as to identify and analyse the obstacle that faced by Land Deed Official Association in the oversight towards to the obedience of the Land Deed Official code of ethic in Boyolali District. This research was conducted using normative empiric legal research method in which the primary data were obtained by interviewing the research subjects and the secondary data refers to legal materials related to the problem. This is descriptive research as the data were analyzed qualitatively. Based on the result of this research, it can be concluded that Land Deed Official Association through its councils, which are Regional Administrator, Regional Council of Honour, District Administrator, and all the member of Land Deed Official Association in Boyolali District has conduct all the oversight measures to minimize violation towards to Land Deed Official code of ethic, in forms of implementation of self-determination to comply with the regulation that related to the role of Land Deed Official, a formal and informal reminder inside a forum, and notification of warning with honourable manner. The obstacle faced by Land Deed Official Association namely internal constraints that came from within each person, namely in the form of Land Deed Official being offended or not accepting when given a warning for the trespass that had occurred, feeling embarrassed or feeling uncomfortable when they wanted to reprimand a Land Deed Official colleague who has committed a trespass, and the feel that they did not receive any benefit from reprimand a colleague that violate the code of ethic. Moreover Land Deed Official Association faced the external constraint that comes from the surroundings environment, which is the ignorance of the violation itself and also the existence of Land Deed Official who refused to join the Land Deed Official Association in Boyolali District.
