INTISARI Tujuan penelitian yaitu untuk mengetahui dan menganalisis kekuatan mengikatnya surat persetujuan Majelis Kehormatan Notaris Wilayah yang ditandatangani selain oleh Ketua Majelis Kehormatan Notaris di Kota Surabaya berdasarkan Putusan Pengadilan Tata Usaha Negara No. 21/G/2017/PTUN SBY dan Putusan Pengadilan Tinggi Tata Usaha Negara No. 156/B/2017/PTUN SBY. Metode penelitian yuridis normatif dilakukan dengan penelitian kepustakaan sebagai data sekunder dan penelitian lapangan menggunakan data primer sebagai pelengkap dengan metode wawancara. Menurut Pasal 24 ayat (2) dan Pasal 23 ayat (2) Peraturan Menteri Hukum dan Hak Asasi Manusia Nomor 7 Tahun 2016 yang berhak mengeluarkan persetujuan adalah Ketua Majelis Kehormatan Notaris Wilayah. Dalam permasalahan ini surat persetujuan pemanggilan notaris ditandatangani oleh Sekretaris dan surat jawaban persetujuan pemanggilan notaris kepada penyidik ditandatangani oleh Wakil Ketua Majelis Kehormatan Notaris Jawa Timur, hal tersebut menimbulkan ketidakjelasan hukum atas kekuatan mengikatnya suatu surat persetujuan. Majelis Hakim memberikan pertimbangannya bahwa tidak adanya delegasi/mandat dari Ketua Majelis Kehormatan Notaris Wilayah Jawa Timur terhadap surat persetujuan tersebut membuat Majelis Hakim untuk mengabulkan gugatan Habib Adjie yang amar putusanya adalah mencabut dan menyatakan tidak berlaku surat persetujuan yang ditandatangani oleh Wakil Ketua Majelis Kehormatan Notaris Wilayah. Sehingga surat persetujuan tersebut tidak memiliki kekuatan mengikat, yang menimbulkan implikasi kerugian materiil dan imateriil, sehingga dibutuhkan pengajuan ulang surat permohonan persetujuan pengambilan minuta akta atau protokol notaris dan pemanggilan notaris sampai mendapatkan persetujuan atau mendapatkan delegasi/mandat oleh Ketua Majelis Kehormatan Notaris Wilayah.

ABSTRACT The research objective was to determine and analyze the binding strength of the Regional Notary Honorary Council approval letter signed by the Chairman of the Notary Honorary Council in Surabaya based on the Decision of the State Administrative Court No. 21 / G / 2017 / PTUN SBY and the Decision of the State Administrative High Court No. 156 / B / 2017 / PTUN SBY. The normative juridical research method was carried out with literature research as secondary data and field research using primary data as a complement to the interview method. According to Article 24 paragraph (2) and Article 23 paragraph (2) Regulation of the Minister of Law and Human Rights Number 7 of 2016, the one who has the right to issue approval is the Chairman of the Regional Notary Honorary Council. In this case the letter of approval for the notary summons is signed by the Secretary and the response letter for the approval of notary summons to investigators is signed by the Deputy Chairperson of the East Java Notary Honorary Council, this has created legal uncertainty over the binding strength of an approval letter. The Panel of Judges gave its consideration that the absence of a delegation/mandate from the Chairperson of the East Java Region Notary Honorary Council for the approval letter made the Panel of Judges to grant Habib Adjie's lawsuit, whose decision was to revoke and declare that the approval letter signed by the Deputy Chairperson of the Regional Notary Honor Council. So that the letter of approval does not have binding power, which implies material and immaterial loss, so it is necessary to re-submit an application for approval to take the original deed or notary protocols and notary summons until to get approval or a delegation/mandate by the Chairman of the Regional Notary Honorary Council.
