PERANAN DEWAN KEHORMATAN DAERAH DALAM MENEGAKKAN KODE ETIK NOTARIS TERHADAP NOTARIS YANG MELANGGAR KETENTUAN PEMASANGAN JUMLAH PAPAN NAMA DI KABUPATEN SLEMAN

Penelitian ini bertujuan untuk mengetahui dan menganalisis penerapan ketentuan Pasal 3 angka 9 bab III Kode Etik Notaris berkaitan dengan jumlah papan nama notaris di Kabupaten Sleman dan menganalisis peran Dewan Kehormatan Daerah dalam pengawasan dan pembinaan terhadap notaris dalam rangka penegakan Pasal 3 angka 9 bab III Kode Etik Notaris.. Penelitian dilakukan dengan menggunakan metode penelitian hukum normatif empiris. Sumber yang digunakan adalah data primer dan data sekunder. Alat penelitian yang digunakan adalah wawancara dengan responden dan narasumber. Data yang diperoleh lalu dianalisis secara kualitatif dengan cara mengkaji data primer dan sekunder, sehingga menghasilkan suatu kesimpulan. Berdasarkan hasil penelitian, dapat disimpulkan bahwa terdapat 2 (dua) kesimpulan. Pertama, penerapan ketentuan Pasal 3 angka 9 bab III Kode Etik Notaris berkaitan dengan jumlah papan nama notaris di Kabupaten Sleman pada kenyataannya terdapat beberapa Notaris di Kabupaten Sleman yang memasang papan nama lebih dari 1(satu) atau tidak sesuai dengan yang diatur di dalam Kode Etik Notaris Pasal 3 angka 9 bab III Kode Etik Notaris, terkait hal tersebut terdapat perbedaan pendapat di kalangan anggota DKD dan DKD sendiri belum pernah menerima pengaduan tentang permasalahan pemasangan papan nama notaris. Kedua, peranan Dewan Kehormatan Daerah dalam rangka melakukan pengawasan dan pembinaan terhadap notaris yang melanggar ketentuan Pasal 3 angka 9 bab III Kode Etik Notaris masih kurang berperan aktif dan memberikan kesan membiarkan pelanggaran terjadi. Dewan Kehormatan Daerah Kabupaten Sleman masih mentolerir kasus tersebut yang mencerminkan sikap kurang tegas dan tutup mata dalam mengetahui kasus tersebut.

This study aims to determine and analyze the application of the provisions of Article 3 point 9 chapter III of the Notary Code of Ethics relating to the number of signboard for notaries in Sleman and to analyze the role of the Regional Honorary Council in the supervision and guidance of notaries in the context of enforcing Article 3 number 9 chapter III of the Notary Code of Ethics. The research was conducted using empirical legal research method. The source that was used was primary data. The research tool that was used was interview with respondents and informants. The data that were obtained were then analyzed qualitatively by reviewing primary and secondary data, resulting in a conclusion which was elaborated inductively. The research results can be drawn 2 (two) conclusions. First, the application of the provisions of Article 3 point 9 chapter III of the Notary Code of Ethics is related to the number of notary signboard in Sleman. In fact, researchers have found many Notaries in Sleman who put up more than 1 (one) signboard or not according to what is regulated in the Notary Code of Ethics Article 3 point 9 chapter III Notary Code of Ethics, there are still debates or opinion differences regarding these rules and the Regional Honorary Council of Sleman has not received any complaints regarding the case. Second, the role of the Regional Honorary Council in the context of supervising and guiding notaries who violate the provisions of Article 3 point 9 chapter III of the Notary Code of Ethics is still not active and gives the impression of allowing violations to occur. The Regional Honorary Council of Sleman still tolerates the case, which reflects a lack of assertiveness and turns a blind eye to the case.
